Terms and Conditions / Privacy Policy (2 of 2)
These Terms and Conditions ("Agreement") govern the services provided by Fairclough Industries, LLC, doing business as Perfect Pooch AZ ("Trainer"), and the client ("Client"). By engaging in any services provided by Trainer, the Client agrees to the following terms:
1. Services and Scope
Trainer provides professional dog training services aimed at enhancing the behavior and obedience of the Client's dog. The success of these services depends on the participation and commitment of the Client and the dog.
2. Client Participation
The Client acknowledges that their active participation in the training process, including completing assigned homework and practicing techniques between sessions, is critical to the success of the training program. Trainer cannot guarantee results, as progress depends on the time, effort, and consistency of the Client's involvement.
3. Training Schedule
The Client understands that the timing and spacing of sessions play a significant role in the dog’s progress. Regression can occur if sessions are spaced too far apart. The Client agrees to follow the Trainer's recommendations for session frequency to achieve the best results.
4. Refund Policy
Refunds will be issued on a prorated basis for any unused sessions or hours remaining in a training package. Refund calculations will:
• Deduct the cost of training tools provided to the Client including access to videos.
• Be based on the number of completed sessions or hours. Refund requests must be submitted in writing, and refunds will be processed within 30 days of approval.
5. Training Tools
Any training tools provided by Trainer are non-returnable and are considered purchased by the Client. These tools are included in the training package cost and are essential for effective training.
6. Assumption of Risk
The Client acknowledges that dog training involves inherent risks, including but not limited to unpredictable animal behavior, injuries to the dog or persons, and property damage. The Client agrees to hold Trainer harmless for any incidents arising during or after the training sessions.
7. Cancellation and Rescheduling Policy
•Rescheduled or cancelled sessions by the client will incur a $50 fee.
8. Termination of Services
Trainer reserves the right to terminate services if the Client fails to comply with these Terms and Conditions or if the Trainer determines that the dog is not a suitable candidate for training due to aggression or other behavioral issues. In such cases, a prorated refund may be issued at the Trainer’s discretion.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Arizona. Any disputes arising under this Agreement shall be resolved through mediation or arbitration, as mutually agreed upon by the parties.
10. Acknowledgment
By engaging in services provided by Trainer, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions. The Client affirms their commitment to the training program and their role in ensuring the success of their dog’s progress.
