Service Contract

This 5 Year Furniture Protection Plan is a service contract between you the original purchaser and Plymouth Furniture, Inc. Please read these terms and conditions carefully. This is a legal contract. By purchasing it, you understand that it is such a contract and acknowledge that you have had the opportunity to read the terms and conditions set forth herein. It describes the protection you will receive in return for payment by you. Keep this document and your sales receipt as you will need them to verify your coverage at the time of service.

1. If a stain or damage listed in the “WHAT IS COVERED” section occurs during the term of this Protection Plan, Plymouth Furniture, Inc. agrees to provide Service (“Service”) as outlined in the “SERVICE PROCEDURES” section of this Protection Plan.

2. This Protection Plan is not a cleaning or maintenance contract, insurance policy, or your original manufacturer warranty.

3. This Protection Plan has a term of five years (“the Term”) from the delivery date of your new furniture.

4. This Protection Plan covers accidental damage from handling, as listed in the “WHAT IS COVERED” section, up to a maximum of the amount paid for the furniture. If over the 5 year plan there are multiple claims, no combination of repairs or replacement can exceed the original amount paid for the furniture.

5. This Protection Plan covers new furniture that you purchased, and appears on the same sales receipt as the Protection Plan, subject to the terms and conditions of this Protection Plan.

6. This Protection Plan is non-transferable and not renewable.

7. You must retain this Furniture Protection Plan and the sale receipt for both the furniture and this Furniture Protection Plan.

REQUIREMENTS FOR REQUESTING SERVICE:

Failure to meet any of the following requirements can result in a denial of Service under this Protection Plan. The furniture must have been delivered and installed soil-free and damage-free from Plymouth Furniture. You must have performed all routine and preventative maintenance, as recommended by the manufacturer.

1. Any stain or damage must be reported to Plymouth Furniture, Inc. within five (5) business days of the date that the stain or damage occurred. Notify Plymouth Furniture by going to: https://www.plymouthfurniturewi.com/service.html and filling out a service request. Please supply the serial number of your furniture and email a copy of your sales receipt and email photos of the problem to [email protected]. If you do not have internet access Text (920) 638-6006, or call (920)892-6006 ext 111 and leave a detailed message about the problem, your name, address, phone number, model number, serial number, date of purchase and whether it was purchased in the regular furniture store or in the clearance center.

2. If a spill occurs, simply blot with a clean, dry cloth. If you attempt to clean a spill, you must follow the cleaning methods recommended by the furniture manufacturer, which is to include pre-testing any product in a hidden area.

3. Many items can be serviced in the home if your home is located within 45 minutes of Plymouth Furniture, Inc. Any furniture located more than 45 minutes of the store or is determined not able to repair in the home you are responsible for bringing your furniture to the store at: Plymouth Furniture 2133 Eastern Ave. Plymouth, WI 53073

4. The use of this plan requires an explanation of where and when the damage occurred as well as detailed description of the actual event.

WHAT IS COVERED:

This Furniture Protection Plan provides Service for any of the following, except for what is listed in the “WHAT IS NOT COVERED” section of this Protection Plan: Fabric, Leather, & Vinyl Upholstered Furniture:

1. Any food or beverage stain from a specific incident.

2. Any human or pet bodily fluid stain from a specific incident.

3. Any ballpoint pen ink stain from a specific incident.

4. Any nail polish/nail polish remover stain from a specific incident.

5. Any puncture, cut, tear, or rip from a specific incident.

6. Any burn from a specific incident.

7. Operational or structural failure to frames, springs, mechanisms, motors, levers (hand wands), and power and remote cords used for sleeper, reclining, and inclining applications, if they were covered by an original manufacturer warranty that has expired.

Wood and Other Hard Surface Furniture:

1. Any food or beverage stain from a specific incident.

2. Any nail polish/nail polish remover stain from a specific incident.

3. Any liquid mark or ring from a specific incident.

4. Breakage.

5. Any scratch, gouge, or chip from a specific incident.

6. Any burn or heat mark from a specific incident.

7. Checking, cracking, bubbling, or peeling of finish from a specific incident.

8. Any chip, scratch, or breakage of glass or mirrors.

9. Loss of silvering on mirrors.

If Plymouth Furniture, Inc. determines that the reported stain or damage is covered under this Furniture Protection Plan, and you have complied with the requirements of this Protection Plan, Plymouth Furniture, Inc. will perform one or more of the following:

1. Plymouth Furniture, Inc. may provide a cleaning kit or advice on how to remove the stain.

2. Plymouth Furniture, Inc. may dispatch an authorized technician to remove the stain or repair the damaged area.

3. Plymouth Furniture, Inc. may replace all or part of the affected area, component, or piece of furniture. Dye lots vary and furniture may fade over time, so replacements may not exactly match the color of non-replaced areas. Plymouth Furniture, Inc. may use non-manufacturers’ parts at the discretion of Plymouth Furniture, Inc., whether or not an equivalent manufacturers’ part is available.

4. Plymouth Furniture, Inc. may arrange for a store credit in an amount equal to the original purchase price of the affected piece of furniture (“Reselection”). Sectionals, dining chair groups, chair and ottoman sets, will be considered a single item for purposes of Reselection. For the purpose of reselection any other item will be considered an individual item and only store credit up to equal the amount paid for that affected piece of furniture will be given. Your Reselection store credit is only valid for 60 days after notification by Plymouth Furniture, Inc. Reselection is by appointment only.

5. Plymouth Furniture, Inc. may offer a settlement amount up to the original purchase price of the furniture.

6. Replacement, Reselection, or a settlement will complete your coverage under this Protection Plan on the area, component, or piece of furniture. Replaced or Reselected furniture is not eligible for a new Plymouth Furniture, Inc. Furniture Protection Plan.

WHAT IS NOT COVERED:

This Furniture Protection Plan provides no Service or benefit for any of the following:

• Any stain or damage that is not specifically listed under the section titled “WHAT IS COVERED.”

• Stains or damage caused by a third party professional contractor, such as painters, movers, construction crews, etc.

• Any stain of unknown origin or accumulation of stains, damage or a soil buildup (as well as, perspiration, hair, and body oil) that occurs from repeated use rather than from a particular incident.

• The accumulation of multiple claims that are not reported individually.

• Normal wear and tear; such as the gradual wear and fading of fabric or leather due to extended use; cracking and peeling of leathers or faux leathers (unless tied to a single incident)

• Odors.

• Stains or damage covered under any manufacturer’s warranties, or under any homeowner’s, renter’s, or other insurance policy.

• Stains or damage caused by structural problems, including, but not limited to, skylights, roofs, or water pipes.

• Stains or damage caused by appliance malfunctions, including, but not limited to, air conditioners and water heaters.

• Any event that should be covered by insurance; such as fire, flood, acts of God, direct lightning strikes to the home, etc…

• Breakdowns or damage as a result of exposure to weather; extreme conditions; pests; sun fading; smoke damage; theft; or consequential loss of any nature.

• Any stain or damage that is not specifically listed under the section titled “WHAT IS COVERED.”

• Noises; squeaks; or customer dissatisfaction with product performance that is not directly related to a breakdown (such as complaints of the item not being comfortable).

• Stains or damage resulting from the improper use or misuse of furniture, including the use of furniture beyond the purpose for which it had been designed or furniture that has not been properly cared for or maintained as per your manufacturer’s warranty.

• Damage caused by abuse; mishandling; while in transit or while in storage.

• When the actions listed in the “REQUIREMENTS FOR REQUESTING SERVICE” have not been followed.

• Stains or damage caused by or resulting in mold or mildew.

• Stains or damage, including color loss or color change, caused by cleaning methods other than those recommended by the furniture manufacturer.

• Repetitive pet damage and repetitive bodily fluid stains are considered preventable occurrences and will not be eligible for Service.

• Stains or damage due to intentional and/or pervasive activities, including, but not limited to, cuts, rips, teething marks, tears, ink, paint, crayon, marker, or pencil damage.

• Furniture that shows signs of infestation, including, but not limited to, insects, termites, cockroaches, and rodents. Manufacturer Quality Issues

• Comfort Wrinkles, and cushions softening are normal wear and tear and are expected to happen.

• Fading, color loss, or color change.

• Loss of foam and/or inner spring resiliency (including body impressions).

• Cracking and peeling of leather, durablend, bonded leather or vinyl.

• Natural leather markings, such as, but not limited to, scars, insect bites, brand marks, and wrinkles.

• Damage resulting from defects in design, materials or workmanship, except for damage specifically listed in the “WHAT IS COVERED” section. Non-Household Environments

• Stains or damage that occur during any delivery or installation process, or before the furniture is delivered to your residence.

• Stains or damage that occur while the furniture is not located within your residence.

• Stains or damage that occur while the furniture is in storage, or being moved to or from storage, or between residences.

• Furniture that is, or has been, used for commercial, institutional, or rental purposes, including daycare. Wear & Tear Caused By Repeated Use (over time) Damage caused by wear, such as, but not limited to, the following:

• Scuffing or other surface abrasions.

• Pilling or fraying of fabric.

• Loose joints.

Definitions

1. “Provider”, “Obligor”, “We”, “Us”, and “Our” mean the company obligated under this plan (Plymouth Furniture, Inc.)

2. “You” and “Your” refer to the purchaser of the product or products covered by this plan.

3. “Proof of Purchase” and “POP” mean the sales invoice, or sales receipt which shows the products you purchased and the furniture protection plan you purchased.

4. “Failure” means the failure of your product to perform its intended function due to mechanical or electrical breakdown resulting from defects in materials or workmanship during normal usage of your product.

5. “Plan” means the terms, conditions, limitations, exceptions and exclusions, including your product proof of purchase.

6. “Accidental Damage” means a single unexpected and unintentional event and does not include accumulated damage from continual or multiple events. PLYMOUTH FURNITURE’S OBLIGATIONS UNDER THIS PROTECTION PLAN ARE BACKED BY THE FULL FAITH AND CREDIT OF PLYMOUTH FURNITURE, INC. AND ARE NOT GUARANTEED UNDER A SERVICE CONTRACT REIMBURSEMENT INSURANCE POLICY. PLYMOUTH FURNITURE, INC. IS NOT LIABLE UNDER THIS PROTECTION PLAN FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES RELATING TO EITHER SERVICES PROVIDED UNDER THIS PROTECTION PLAN OR FURNITURE COVERED BY THE PROTECTION PLAN.

You may cancel and return the Protection Plan to Plymouth Furniture, Inc. for a partial refund of its purchase price within 20 days after its delivery. If no service has been provided under the Protection Plan on the date of your cancellation of it, the Protection Plan is void and Plymouth Furniture, Inc. shall refund to you its partial purchase price. A cancellation fee equal to the lesser of 15% of the Protection Plan’s purchase price or Fifty and 00/100 Dollars ($50.00) may be deducted from the purchase price.

Plymouth Furniture, Inc. may not cancel the Plan, although under certain circumstances your coverage may end following resolution of a claim as described in the “Service Procedures” section on Page 1. You may not cancel the Plan after expiration of the applicable return period described above.

Any dispute between the purchaser and the obligor of the plan will be determined by binding arbitration. If there is an unresolved dispute between you and us concerning this plan (including the cost of, lack of or actual repair or replacement arising from a breakdown). Under this arbitration provision, you give up your right to resolve any dispute arising from this plan by a judge and/or jury. You also agree not to participate as a class representative or class member in any class action litigation, any class arbitration or any consolidation of individual arbitrations. In arbitration, a group of three arbitrators (each of whom is an independent, neutral third party) will give a decision after hearing your and our positions. The decision of a majority of the arbitrators will determine the outcome of the arbitration and the decision of the arbitrators shall be final and binding and cannot be reviewed or changed by, or appealed to, a court of law. Any dispute on the application of this arbitration provision will be made by the local court of law in Sheboygan County, WI. The furniture covered under the Furniture Protection Plan, the Furniture Protection Plan’s purchase price and its seller are listed on your sales receipt. There is no deductible under the Furniture Protection Plan. Service requests are paid only when a Plymouth Furniture, Inc. approved service technician makes the repair. You may not sell or transfer your rights under the Furniture Protection Plan. Except as provided above, you do not have the right after 20 days to cancel the Protection Plan if you return the product covered or it is sold, lost, stolen, or destroyed. You do not have the right to renew the Protection Plan after it expires.

Ineligible Furniture & Components:

• Furniture sold with stains or damage prior to delivery (“as is”).

• Customer’s Own Material (COM) items. • Stains or damage to nubuck, aniline leather, suede, or exotic leathers.

• Stains or damage to “X” cleaning code fabrics (Can only be vacuumed and cannot be cleaned with any type of cleaner) and non-colorfast fabrics and leathers (fabric or leather that loses color when cleaned according to the manufacturer’s cleaning instructions).

• Components and mechanisms integrated into furniture; including, but not limited to, adjustable bed frames, sinks, plumbing, robotics, TV lifts, fireplace, clocks, refrigeration, lighting, or others that are not included in the “WHAT IS COVERED” section.

• Wicker and rattan furniture.

• Mattresses.
