1. Introduction

Welcome to SurfYogaBeer, LLC (“SurfYogaBeer,” “SYB,” “we,” “us,” or “our”).

This Participant Waiver & Release of Liability (“Agreement”) applies to all individuals participating in any SurfYogaBeer trip, event, or activity.

By booking, attending, or participating in any SurfYogaBeer experience, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.

2. Assumption of Risk

I understand and acknowledge that participation in SurfYogaBeer trips and activities—including but not limited to surfing, swimming, fitness classes, yoga, hiking, cycling, running, boating, excursions, vehicle transportation, and all related activities—involves inherent and unpredictable risks.

These risks include, but are not limited to:

• physical injury

• illness or disease

• accidents

• property damage or loss

• disability

• death

I voluntarily and knowingly assume all such risks, whether foreseen or unforeseen, associated with my participation.

3. Release of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I, ON BEHALF OF MYSELF AND MY HEIRS, EXECUTORS, ADMINISTRATORS, SUCCESSORS, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS SURFYOGABEER, LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, OR LIABILITIES ARISING OUT OF OR RELATED TO MY PARTICIPATION IN ANY SURFYOGABEER ACTIVITY.

I EXPRESSLY ACKNOWLEDGE AND AGREE THAT THIS RELEASE INCLUDES ANY CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.

4. Third-Party Services & Independent Contractors

I understand that SurfYogaBeer does not own, control, or operate many of the accommodations, transportation providers, activity operators, or other services used during trips.

These third-party providers are independent contractors. SurfYogaBeer is not responsible for their acts, errors, omissions, or negligence.

I expressly release SurfYogaBeer from any liability arising from the acts or omissions of any third-party provider.

5. Travel-Specific Risks

I acknowledge that participation in international and domestic travel involves additional risks, including but not limited to:

• transportation delays or disruptions

• political instability

• crime

• foodborne illness

• limited access to medical care

• varying safety standards

• environmental hazards

I voluntarily assume all such risks.

6. Fitness, Medical Acknowledgment & Age Requirement

I certify that I am physically and mentally fit to participate and have no condition that would prevent my safe involvement.

I understand that SurfYogaBeer does not provide medical advice, physical therapy, or personalized fitness instruction.

I agree to consult a physician prior to participation if necessary.

In the event of illness or injury, I authorize SurfYogaBeer to obtain emergency medical care on my behalf if deemed necessary, and I agree to bear all associated costs.

Participation in SurfYogaBeer trips is restricted to individuals who are 21 years of age or older. By participating, I confirm that I am at least 21 years of age.

7. Travel Insurance (Required)

Travel insurance is required to participate in all SurfYogaBeer trips.

I am solely responsible for purchasing a policy that provides adequate coverage, including:

• medical expenses

• trip interruption

• trip cancellation

• emergency evacuation

By participating, I confirm that I have obtained appropriate insurance and accept full responsibility for any costs incurred due to illness, injury, cancellations, delays, or other unforeseen events.

SurfYogaBeer is not responsible for any losses that would otherwise be covered by travel insurance.

SurfYogaBeer reserves the right to request proof of insurance prior to participation.

8. Conduct & Alcohol Responsibility

I acknowledge that I am solely responsible for my actions and behavior during the trip, including my consumption of alcohol.

I agree not to participate in activities while impaired in a manner that endangers myself or others.

I agree to follow all instructions from SurfYogaBeer staff and trip leaders.

SurfYogaBeer reserves the right to remove me from any activity or trip, without refund, for unsafe, disruptive, illegal, or inappropriate behavior.

9. No Guarantees & Itinerary Changes

I understand that itineraries, accommodations, activities, and experiences may change due to weather, safety considerations, or other factors beyond SurfYogaBeer’s control.

No specific outcomes or experiences are guaranteed.

10. Indemnification

I agree to defend, indemnify, and hold harmless SurfYogaBeer, LLC from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of my participation, conduct, or breach of this Agreement.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SURFYOGABEER’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT I PAID FOR THE TRIP.

12. Media Release

I grant SurfYogaBeer permission to use my likeness, image, voice, and statements in photographs, videos, or other media for marketing and promotional purposes worldwide, in perpetuity, without compensation.

If I wish to opt out, I must notify SurfYogaBeer in writing no later than 24 hours before my trip departure date via email to [email protected].

13. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in Florida.

I waive any right to a trial by jury and agree that any claims must be brought in my individual capacity and not as part of any class or collective action.

14. Force Majeure

SurfYogaBeer shall not be liable for any failure or delay in performance due to events beyond its control, including but not limited to natural disasters, weather conditions, pandemics, government actions, or transportation disruptions.

15. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes any prior communications, representations, or agreements.

17. Acknowledgment & Acceptance

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

18. Electronic Signature & Acknowledgment

I agree that checking the box and/or signing electronically constitutes my legally binding signature.

I acknowledge and agree that:

• I have carefully read this Agreement in full

• I fully understand its terms and legal effect

• I am signing this Agreement voluntarily and without any inducement

• I understand that I am waiving certain legal rights, including the right to sue

• I have had the opportunity to ask questions or seek legal advice before signing
