Waste Away LLC Service Agreement

Terms of Lease & Service

Term: The term of this Service Agreement for dumpster services ("Services") is 6 days, starting from the delivery date by Waste Away LLC ("Contractor"). Performance of services will bind this Agreement if unsigned by the Customer, effective from the order date.

Pricing & Rentals: Rental Price includes delivery, pick-up, and landfill disposal unless otherwise agreed. Extended rental beyond 6 days incurs a $35 per day fee. Additional servicing for elite containers' portable toilets is $95 per call for longer rentals.

Customer's Duties and Liability: Customer shall safeguard Contractor's equipment and provide a safe environment. Overloading, incineration, or moving equipment without consent is prohibited. Customer is liable for damages beyond wear and tear, including weight exceeding 5 tons.

Liability & Indemnity: Customer indemnifies Contractor against injury, property damage, or death arising from equipment use. Contractor disclaims liability beyond remedies in the Agreement and shall not be liable for incidental or consequential damages.

Fees & Charges: Excess weight incurs a $65 per ton charge. Handling overfilled containers, prohibited waste removal, cancellations, change of location, or unserviceable conditions will have respective fees of $150.

Access & Site Conditions: Customer warrants site access, bearing weight, and clearance. Contractor is not liable for damage to surfaces or incidental property damage during service.

Waste Material & Prohibited Items: Customer agrees to dispose of permitted waste only. Prohibited items include hazardous materials, electronics, tires, appliances with Freon, and liquid waste. Customer will remove Prohibited Materials, reimbursing disposal costs plus 25%.

Payment Terms: Rental fees are due upon order. Additional charges will be billed upon container pick-up. Contractor may charge late fees for overdue payments and suspend services for non-payment.

Permits & Liability: Customer is responsible for obtaining necessary permits. Contractor shall not be liable for damage to property during service and assumes no liability for damage resulting from use of third-party services.

General: These Terms and Conditions prevail over other communications. Any variations require written agreement by the Contractor.
