Community Smart Funding

Welcome to Community Smart Funding. These Terms of Service (“Terms”) govern your use of the Community Smart Funding website, fundraising pages, Smart Voucher pages, donation pages, and related services.
By accessing our website, purchasing a Smart Voucher, making a donation, submitting information, or otherwise using Community Smart Funding services, you agree to these Terms.
If you do not agree with these Terms, please do not use our services.
1. About Community Smart Funding
Community Smart Funding provides a platform and administrative service designed to connect community organizations, local businesses, supporters, and customers.
Participating businesses may offer Smart Vouchers that customers can purchase through Community Smart Funding pages. A predetermined portion of qualifying voucher proceeds is allocated to the participating community organization, while Community Smart Funding retains an agreed portion to compensate us for providing the program, technology, marketing, administration, voucher creation, automation, and related services.
Community Smart Funding acts as an intermediary and program administrator. Unless expressly stated otherwise, we are not the business providing the goods or services represented by a Smart Voucher.
2. Smart Vouchers
Smart Vouchers are promotional certificates or digital vouchers offered by participating businesses.
Each voucher may contain its own:
Purchase price
Promotional value
Offer description
Redemption requirements
Restrictions
Limitations
Validity or promotional period
Participating business information
Customers should review the specific terms displayed with a Smart Voucher before purchasing it.
By purchasing a Smart Voucher, you agree to the specific terms associated with that voucher in addition to these Terms of Service.
3. Responsibility of Participating Businesses
The participating business offering a Smart Voucher is responsible for providing the goods or services described in the voucher and honoring the voucher according to its stated terms and applicable law.
Community Smart Funding creates and administers the digital voucher program but does not directly provide the underlying products or services offered by participating businesses.
Questions or disputes concerning the quality, availability, delivery, safety, or performance of a participating business's products or services should generally be addressed directly with that business.
Community Smart Funding may assist in resolving voucher-related issues when reasonably possible, but we cannot guarantee the performance of an independently owned participating business.
4. Voucher Redemption
Smart Vouchers are intended to be redeemed directly with the participating business providing the goods or services.
Customers should redeem a voucher only at the participating business at the time the applicable goods or services are being provided or when instructed by the participating business.
Once a Smart Voucher is marked as redeemed, it may no longer be available for additional use.
Customers should therefore not press, activate, scan, or otherwise use a redemption function until they are actually redeeming the voucher with the participating business.
Community Smart Funding is not responsible for vouchers accidentally or prematurely redeemed by the customer, although we may attempt to assist when the circumstances can reasonably be verified.
5. Voucher Expiration and Promotional Value
Certain Smart Vouchers may include a promotional value that is available only during a specified promotional period.
Any expiration date or promotional limitation will be displayed with the applicable voucher.
The treatment of the amount originally paid for a voucher after expiration of its promotional value will be governed by the terms of the particular voucher and applicable federal, state, and local law.
Nothing in these Terms is intended to eliminate any rights a customer may have under applicable gift certificate, gift card, voucher, or consumer protection laws.
6. Voucher Restrictions
Individual Smart Vouchers may contain restrictions such as:
Limit one per customer
New customers only
Appointment required
Certain products or services excluded
Minimum purchase requirements
Specific days or times of use
Cannot be combined with other promotions
Promotional value expiration dates
Other reasonable restrictions established by the participating business
These restrictions should be disclosed with the applicable offer and become part of the terms governing that Smart Voucher.
7. Payments and Distribution of Voucher Proceeds
When a Smart Voucher is purchased, proceeds may be divided among the participating business, participating community organization, Community Smart Funding, and applicable payment-processing services according to the arrangements established for that campaign.
Community Smart Funding may retain a predetermined portion of the Smart Voucher sale price as compensation for services including program administration, marketing, technology, voucher creation, payment coordination, automation, customer communications, and related operating expenses.
The applicable participating business and community organization agree to their respective financial arrangements separately as part of their participation in the Community Smart Funding program.
8. Payment Processing
Payments may be processed by third-party payment providers.
By completing a purchase or donation, you authorize the applicable payment provider to process the transaction according to its terms and policies.
Community Smart Funding does not guarantee uninterrupted availability of third-party payment systems and is not responsible for outages, processing delays, or errors outside our reasonable control.
9. Refunds
Unless otherwise required by law or stated in the specific Smart Voucher offer, Smart Voucher purchases are generally considered final after purchase.
However, Community Smart Funding may review refund requests involving circumstances such as:
Duplicate transactions
Processing errors
A participating business permanently closing before redemption
A participating business refusing to honor a valid voucher
Material errors in the voucher description
Other exceptional circumstances
Approval of a refund is not guaranteed and may depend upon the circumstances, the participating business's policies, the status of distributed funds, and applicable law.
Nothing in this section limits any refund or consumer rights required by applicable law.
10. Donations
Community Smart Funding may provide opportunities for users to make monetary donations benefiting participating community organizations.
Where applicable, donations may be processed directly through accounts associated with the receiving organization or through third-party payment-processing systems.
Unless specifically stated otherwise, Community Smart Funding does not represent or guarantee that any payment, contribution, Smart Voucher purchase, or donation is tax deductible.
Whether a contribution is tax deductible depends upon the recipient organization's tax status, the nature of the transaction, and applicable tax law.
Donors should consult the receiving organization or a qualified tax professional regarding tax deductibility.
11. Community Organization Participation
Community organizations participating in Community Smart Funding are responsible for providing accurate information about their organization and their authority to participate in fundraising activities.
Participation in Community Smart Funding does not constitute an endorsement, certification, or guarantee by Community Smart Funding regarding an organization's tax-exempt status, charitable status, operations, or use of funds.
Community Smart Funding reserves the right to approve, decline, suspend, or discontinue an organization's participation in the program.
12. Business Participation
Businesses participating in Community Smart Funding agree to provide accurate information regarding their business and Smart Voucher offers.
Participating businesses are responsible for:
Honoring valid Smart Vouchers
Providing the advertised products or services
Clearly communicating applicable restrictions
Maintaining any licenses or permits required for their business
Complying with applicable laws
Providing reasonable customer service to voucher purchasers
Informing Community Smart Funding of material changes affecting an active voucher offer
Community Smart Funding reserves the right to reject, suspend, or discontinue any business or voucher offer that we believe is inappropriate, misleading, unlawful, harmful to the reputation of the program, or inconsistent with Community Smart Funding's purpose.
13. Communications
Customers who purchase Smart Vouchers may receive transactional communications necessary to administer their purchase.
These may include:
Purchase confirmations
Voucher delivery
Redemption instructions
Reminders regarding unused vouchers
Customer service messages
Redemption confirmations
Review requests
Marketing or promotional communications will be handled in accordance with applicable law and our Privacy Policy.
Users may unsubscribe from promotional emails through the unsubscribe mechanism provided in those communications.
Where applicable, users may opt out of promotional text messages by replying STOP.
14. Reviews and Feedback
After redeeming a Smart Voucher, customers may be invited to provide feedback or review their experience.
Providing a review is voluntary.
Community Smart Funding does not require customers to provide a positive review and does not guarantee the accuracy of reviews or opinions expressed by customers regarding participating businesses or organizations.
15. Prohibited Uses
You may not use Community Smart Funding services to:
Commit fraud
Attempt to redeem a voucher more than permitted
Copy, duplicate, sell, or improperly transfer a voucher
Manipulate voucher redemption systems
Submit false information
Impersonate another person or organization
Interfere with the operation or security of our website
Attempt unauthorized access to accounts or systems
Use our services for unlawful purposes
We reserve the right to suspend or terminate access to our services and invalidate improperly obtained or fraudulently used vouchers when reasonably necessary.
16. Intellectual Property
The Community Smart Funding name, website content, designs, graphics, program materials, voucher designs, software elements, and related materials may be protected by copyright, trademark, or other intellectual property laws.
Participating businesses and organizations retain ownership of their respective names, logos, trademarks, photographs, and other materials.
By providing such materials to Community Smart Funding, a participating business or organization grants us permission to use them as reasonably necessary to create, promote, and administer its Community Smart Funding pages, Smart Vouchers, campaigns, and related marketing materials.
17. Third-Party Services and Websites
Our services may contain links to or integrations with participating businesses, community organizations, payment processors, social media platforms, digital wallet providers, and other third-party services.
Community Smart Funding does not control these independent third parties and is not responsible for their websites, products, services, privacy practices, availability, or security.
18. Service Availability
We make reasonable efforts to keep Community Smart Funding websites, voucher systems, and related services operational.
However, we do not guarantee that services will always be uninterrupted, error-free, or available.
Temporary interruptions may occur because of maintenance, internet outages, third-party providers, payment processors, software systems, circumstances beyond our control, or other technical issues.
19. Disclaimer of Warranties
Community Smart Funding provides its platform and related services on an “as available” and “as is” basis to the extent permitted by law.
We do not guarantee the quality, safety, suitability, availability, or performance of products or services provided by independent participating businesses.
We also do not guarantee any particular fundraising result, number of voucher sales, amount of business exposure, number of customers, or financial outcome for participating businesses or organizations.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Community Smart Funding will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from the use of our services or the goods or services provided by participating businesses.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
21. Indemnification
To the extent permitted by law, participating businesses and organizations agree to be responsible for claims arising from their own actions, representations, products, services, negligence, legal violations, or failure to comply with their obligations under the Community Smart Funding program.
Nothing in this provision is intended to impose responsibility on a consumer beyond what is permitted by applicable law.
22. Privacy
Use of Community Smart Funding is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information.
The Privacy Policy is incorporated into these Terms by reference.
23. Changes to These Terms
Community Smart Funding may update these Terms periodically to reflect changes in our program, technology, business practices, or legal requirements.
The Effective Date at the top of these Terms will indicate the most recent version.
Continued use of Community Smart Funding after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
24. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction's mandatory consumer protection laws provide otherwise.
