RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

I represent that I am physically fit, physically sound and that I have medical approval, if necessary, to use ATP Fitness exercise facilities and equipment and to participate in any of the exercise classes or other programs at ATP Fitness. I understand that ATP Fitness is relying on this representation and does not verify or certify my health or fitness.

I understand that participating in any exercise activity, program or service (including but not limited to Personal Training, Weight Training, Pilates, Yoga, or Nutritional Guidance) involves the risk of serious physical injury, death or other damage. I voluntarily participate in all ATP Fitness programs, classes, and activities, including off-site, and assume all associated risks, including injury, illness, death, and/or loss or damage to personal property.

In consideration of the use of ATP Fitness premises, equipment, and services, I release ATP Fitness from any and all liability for injuries, death, or damage to personal property resulting from my participation. This includes but is not limited to injuries caused by negligence, equipment failure, instruction errors, on-site hazards, or emergency response failures.

I acknowledge and agree to the following:

- ATP Fitness is not responsible for financial transactions between me and my trainer.

- ATP Fitness may photograph or record me and use these images/videos for promotional purposes without compensation.

- I will disclose any physical limitations in writing before participating in services or sessions.

- Trainers and staff are not licensed medical professionals and cannot diagnose conditions or prescribe treatment.

- This agreement remains in effect for all future activities at ATP Fitness.

If any legal action is necessary to enforce this agreement, the prevailing party is entitled to attorney’s fees. If any part of this waiver is found invalid, the rest remains enforceable. This agreement is the complete understanding between me and ATP Fitness.
