Serve Challenge Participant Agreement, Release of Liability, and Consent
Watering Seeds Organization — Serve Challenge
This Participant Agreement, Release of Liability, and Consent ("Agreement") is entered into between the person completing and submitting the registration form ("you") and Watering Seeds Organization, a 501(c)(3) nonprofit organization ("Organization"), and governs registration for and participation in the Serve Challenge, including the in-person event on Saturday, November 7, 2026, from 9:00 a.m. to 12:00 p.m., at Fall Creek Tennis Academy in Humble, Texas, together with all related online, social-media, community-service, and campaign activities (collectively, the "Challenge"). The person taking part in the Challenge is the "Participant." If you are not the Participant, you certify in Section 6 that you are the Participant's parent or legal guardian.
1. Rules Agreement and Participation Acknowledgment
You confirm that you have read, understand, and agree to the official Serve Challenge rules published by the Organization.
Participation in the Challenge may involve tennis-related physical activity, including serving a tennis ball, practice, filming and posting content, sharing campaign materials, and attending the in-person Challenge event. The Participant agrees to participate safely and within his or her own skill level and physical condition, and to follow all posted instructions, event rules, and facility rules.
The Organization reserves the right to review, reject, remove, or disqualify any entry or Participant that is unsafe, unlawful, inappropriate, misleading, or in violation of another person's rights or the official Challenge rules. You confirm that all information submitted in registration is accurate.
2. Assumption of Risk and Release of Liability
Participation in the Challenge is voluntary. Physical activity, including tennis-related activity, involves inherent risks, including the risk of personal injury, illness, property damage, and other loss. The Participant (and you on the Participant's behalf, if applicable) voluntarily assumes all risks associated with participation in the Challenge, both known and unknown.
To the fullest extent permitted by law, the Participant (and you on the Participant's behalf, if applicable) releases, waives, and holds harmless the Organization and its officers, directors, employees, volunteers, contractors, sponsors, partners, affiliates, representatives, agents, event hosts, venues, and facilities (collectively, the "Released Parties") from any and all claims, demands, liabilities, damages, costs, and expenses arising out of or relating to participation in the Challenge. This release does not apply to claims arising from a Released Party's gross negligence or willful misconduct, or to any liability that cannot lawfully be waived.
3. Content Ownership and Operational Use
You confirm that the Participant owns or has obtained all necessary rights and permissions for any photograph, video, audio, text, or other content ("Content") submitted in connection with the Challenge; that any identifiable person appearing in the Content has consented to appear; and that a parent or legal guardian has provided permission for any minor appearing in the Content. The Participant agrees not to submit Content containing copyrighted music, third-party logos, private information, or other material protected by another's rights unless the necessary rights and permissions have been obtained.
The Participant grants the Organization permission to review, verify, and use submitted Content as reasonably necessary to administer the Challenge, including verifying entries, judging, scoring, and announcing results.
