Description of Activities

Activities at The LAB – Glendale (“The LAB”) include, but are not limited to, climbing, swinging, crawling, jumping, running, hanging, balancing, vaulting, and other obstacle-based movements. These activities are designed to provide fun, physical fitness, skill development, competition, agility, balance, and recreational benefits.

Participation levels may range from moderate to very vigorous depending on the participant’s abilities, choices, and effort. Activities are suitable for both beginners and experienced participants who exercise appropriate caution. Physical exertion is inherent to all activities at The LAB.

Safety Acknowledgment

The LAB prioritizes participant safety and implements measures to reduce risk, including padded flooring and surfaces, safety instruction, trained staff, supervision, and emergency response equipment. However, no activity is risk-free, and certain inherent risks cannot be eliminated.

Inherent Risks

These risks include, but are not limited to:

Falls, slips, or collisions with equipment or other participants (“CO-PARTICIPANTS”)

Improper landings or loss of grip

Contact with structural elements or exposed surfaces

Equipment failure or unknown hazards

Differences in size, strength, or ability between participants

Negligent acts or omissions by participants, CO-PARTICIPANTS, or staff

Assumption of Risk

I acknowledge that participation in activities at The LAB involves inherent risks that may result in injury, illness, disability, or death. I understand these risks exist regardless of the care taken by The LAB.

I affirm that:

I understand the nature of the activities;

I am aware of the physical demands relative to my (or my child’s) condition and abilities; and

I accept full responsibility for participation.

Participation is voluntary, and I knowingly assume all inherent risks on behalf of myself and, if applicable, my minor child or ward.

Waiver and Release of Liability

In consideration of being permitted to participate in activities at The LAB – Glendale, I, on behalf of myself and any minor child or ward, waive, release, and discharge The LAB, its owners, officers, employees, contractors, volunteers, affiliates, successors, and assigns (“PROTECTED PARTIES”) from any and all claims or causes of action, including those arising from ordinary negligence, to the fullest extent permitted by Arizona law.

This release applies to:

Personal injury, illness, disability, or death;

Loss, theft, or damage of personal property; and

Any consequential damages arising from participation.

Indemnification

I agree to defend, indemnify, and hold harmless The LAB and PROTECTED PARTIES from any claims, damages, costs, or expenses (including attorneys’ fees) arising from my or my child’s participation, including claims brought by CO-PARTICIPANTS or third parties.

Dispute Resolution

Any dispute arising from this Agreement or participation at The LAB shall first be attempted to be resolved through good-faith mediation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.

This Agreement shall be governed by the laws of the State of Arizona, and venue shall lie exclusively in Arizona.

Health & Emergency Care Acknowledgment

I affirm that:

I (and/or my child) am physically capable of participation

I understand and assume risks related to pre-existing medical conditions

I will stop participation if discomfort or distress occurs

The LAB may administer first aid, CPR, or emergency medical care if necessary

I am financially responsible for all medical costs incurred

Rules & Conduct

I agree to:

Follow all posted rules and staff instructions

Attempt only activities I feel capable of completing safely

Act responsibly and respectfully toward others

Accept that The LAB may terminate participation for safety reasons

Likeness Release

I grant The LAB permission to use my and/or my child’s likeness in photographs or video for marketing, promotional, and educational purposes without compensation.

Acknowledgment & Signature

I understand that by signing this Agreement, I am giving up substantial legal rights, including the right to sue. I confirm that I have read and understand this Agreement and signed it voluntarily.
