TEST DRIVE RELEASE & WAIVER OF LIABILITY
By signing below, I, the undersigned customer, voluntarily agree to test drive a vehicle owned by Dell’s Powersports (“the Dealership”), located at 1100 NW Bush Dr, Grain Valley, MO. I acknowledge that operating a motorcycle, ATV, UTV, watercraft, or similar powersports vehicle involves inherent risks including bodily injury, death, or property damage. I certify that I hold a valid driver’s license suitable for the vehicle type, am not under the influence of drugs or alcohol, and will operate the vehicle in a legal, safe, and responsible manner at all times. I assume full financial responsibility for any and all loss, theft, damage, or injury caused during the test drive, whether to myself, others, or the vehicle. I understand that the Dealership does not provide insurance coverage for test drives and that I am personally liable for all resulting costs, including but not limited to towing, repairs, medical treatment, and legal claims. I further agree to release, waive, and forever discharge Dell’s Powersports, its owners, employees, and affiliates from any and all liability, claims, or causes of action arising from the test drive, including but not limited to claims based on negligence. I will not allow anyone else to operate the vehicle, will not race, perform stunts, or operate the vehicle off of approved roads or areas. I agree to indemnify and hold harmless the Dealership from any claims, injuries, or damages caused during or resulting from the test drive. I acknowledge that I have read, understood, and voluntarily agree to the terms of this waiver, and that this waiver is binding under the laws of the State of Missouri.
