I agree that I am voluntarily engaging in activities with Lumber Capital Athletics (dba. Lumber Capital Run Club) (“LCRC”), and I know that running in and volunteering for organized group runs with  LCRC and its social events, runs, and races (collectively, “events”) are potentially hazardous activities which could cause injury or death. I will not participate in any  LCRC events, unless I am medically able and properly trained. By my agreement, I certify that I am in good health and medically able to perform and participate in all events.

I ASSUME ALL RISKS ASSOCIATED WITH ANY EVENT INCLUDING WITHOUT LIMITATION, FALLS; CONTACT WITH OTHER PARTICIPANTS; THE EFFECTS OF THE WEATHER, INCLUDING, WITHOUT LIMITATION, HAIL, HIGH HEAT AND/OR HUMIDITY; TRAFFIC; SIGNAGE OR LACK THEREOF; AND ROAD OR PATH CONDITIONS; AND ALL SUCH RISKS BEING KNOWN AND APPRECIATED BY ME. HAVING READ THIS WAIVER AND KNOWING THESE FACTS AND IN CONSIDERATION OF ATTENDING COMMON EVENTS I, FOR MYSELF AND ANYONE ENTITLED TO ACT ON MY BEHALF, WAIVE AND RELEASE COMMON AND ITS DIRECTORS, OFFICERS, SUB-CONTRACTORS, VOLUNTEERS, EMPLOYEES, AGENTS, MARKETERS, CLUB MEMBERS, DESIGNEES, SPONSORS AND THEIR REPRESENTATIVES AND SUCCESSORS FROM ALL CLAIMS, ACTIONS, DAMAGES, COSTS, EXPENSES, OR LIABILITIES OF ANY KIND ARISING OUT OF MY PARTICIPATION WITH ARC, EVEN THOUGH THAT LIABILITY MAY ARISE OUT OF NEGLIGENCE OR CARELESSNESS ON THE PART OF ARC AND THE ENTITIES OR PERSONS NAMED IN THIS WAIVER.

This liability waiver shall be governed and construed in accordance with the laws of the state of Pennsylvania.

I further grant Lumber Capital Athletics (dba. Lumber Capital Run Club) (“LCRC”).  LCRC non-revocable permission to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “images”). I acknowledge that LCRC will own such images and further grant LCRC permission to copyright, display, publish, distribute, use, modify, print and reprint such images in any manner whatsoever related to LCRC, and/or LCRC business, including without limitation, social media, marketing platforms, publications, promotions, advertisements, brochures, website images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the image by LCRC prior to its use, and additionally waive any right to any profit LCRC may obtain from the use of the aforementioned images. I forever release and hold LCRC harmless from any and all liability arising out of the use of the images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the images, including without limitation, claims for invasion of privacy rights or publicity.
