Participant Waiver of Liability & Indemnity Agreement

Waiver: I hereby release, waive, discharge and covenant not to sue International Sports Academy, LLC (“ISA”), its directors, officers, employees, volunteers, independent contractors, and agents (“Releasees”) from any and all claims.

Release & Hold Harmless: I hereby release and hold harmless ISA and all of the above Releasees with respect to any and all injury, disability, death or loss or damage to person or property incident to student-athlete (“Student”) involvement or participation in any and all of the ISA training programs (“Training”), transportation, or lodging, releasing any and all claims, to the fullest extent permitted by law in the State of Ohio.

Indemnity. I hereby indemnify and hold harmless ISA and all of the above Releasees from any and all liabilities incident to Student involvement or participation in any and all of the Training, releasing any and all claims, to the fullest extent permitted by law in the State of Ohio.

Publicity. I understand, give permission to, and agree that ISA retains the right to use, for publicity and advertising, photographs and videos of Students taken at during any program activities..

Limitation of Liability: I agree that the total liability ISA, its affiliated entities and respective directors, officers, employees, and agents with respect to services performed or to be performed by ISA, shall not exceed 100% of the compensation received by ISA, from me pertaining to Student. The parties agree and acknowledge this section of this Agreement is a material part of the consideration for this Agreement.

Severability: In the event that any provision of this Agreement or Participation Agreement for ISA, or the application of any such provision to any person or set of circumstances, shall be determined to be invalid, unlawful or unenforceable, the remainder of this Agreement shall continue to be valid and enforceable to the fullest extent permitted by law in the State of Ohio.

Acknowledgement: I have read this waiver of liability and indemnification agreement and fully understand the terms. I understand that I am giving up substantial rights, including my right to sue. I agree that I am signing the agreement freely and voluntarily and I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law in the State of Ohio.

Participation Agreement

I the parent/guardian of the student-athlete named (the “Student”), do hereby permit the Student to participate (the “Participant”) in all of the International Sports Academy (“ISA”) training programs. Training programs include all athletic training sessions and competitive matches organized by ISA, whether they take place on site at Cedar Point Sports Center (“CPSC”), Sandusky Central Catholic High School (“SCC”) or off site at other locations such as gyms, arenas, fitness centers, weight rooms, outdoors, or any other location where ISA program activities take place. I certify that the Student’s physical condition is sufficient for full participation. I understand that the Student’s participation involves an element of risk and danger of accidents.

I understand that physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to the next, but I understand that risks range from minor injuries such as scratches or bruises to major injuries such as loss of sight, joint or back injuries, concussions, heart attacks, and even catastrophic injuries such as paralysis and death.
I understand the demands of physical activity related to my physical condition and skill level. I acknowledge that my participation is voluntary and I knowingly assume all such risks.
I also understand that the Student’s participation as part of ISA may include activities involving student-athletes of different ages participating together, and on occasion those of the opposite gender. Knowing those risks, I hereby assume those risks and I hereby release and discharge The International Sports Academy, LLC from any and all liability resulting from the Student’s participation in and aspect of the ISA programs. I hereby assume responsibility for any and all costs associated with treatment of the Student for any injury or health issue that arises during the Student’s participation in ISA.
I acknowledge that I am signing the agreement freely and voluntarily and that my signature signifies complete assumption of all risks, both know and unknown, of participation in any ISA program.

RETURN TO PLAY WAIVER

In consideration of being allowed to participate in any way in the International Sports Academy, LLC ("ISA") sports training, academic programs, or other related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1. The risk of injury and/or illness from the activities involved in the program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist;

2. The risk to have contact with individuals, who have been exposed to and/or have been diagnosed with one or more communicable diseases, including but not limited to COVID-19 or other medical conditions, diseases, or maladies does exist, and it is impossible to eliminate the risk that I could be exposed to and/or become infected through contact with or close proximity with an individual with a communicable disease;

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume all full responsibility for my participation;

4. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and

5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS THE INTERNATIONAL SPORTS ACADEMY, LLC ("ISA"), their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of the premises used to conduct the event ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES
OR OTHERWISE.

6. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, BEFORE SIGNING THIS DOCUMENT, AND I FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT ON MY OWN BEHALF OR ON BEHALF OF THE YOUTH PARTICIPANT ASSOCIATED WITH THIS GUARDIAN ACCOUNT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Authorization and Waiver to Transport Participant

I authorize International Sports Academy, LLC (“ISA”), to transport my minor Participant, or adult Participant, in a Van, Bus, or Car driven by an individuals authorized by ISA. I understand Participant is expected to follow all applicable laws regarding riding in a motor vehicle and is expected to follow the directions provided by the driver and/or staff, contractor or volunteer. I understand participation in the identified event(s) is not a requirement for participation in the program.

I have read, understand, and discussed with Participant that:

(1) Participant will travel in a motor vehicle driven by an adult Participant is to wear their safety belt during travel;

(2) Participant is expected to listen to supervising staff/driver, respect staff and other Participants traveling and the vehicles themselves;

(3) Riding in a motor vehicle may result in personal injuries or death from wrecks, collisions or acts by riders, other drivers, or objects; and,

(4) Participant is to remain in their seat and not be disruptive to the driver of the vehicle.

I recognize participation in this activity, as with any activity involving motor vehicle transportation, Participant may risk personal injury or permanent loss. I hereby attest and verify I have been advised of the potential risks, and I have full knowledge of the risks involved in this activity, and I assume any expenses incurred in the event of an accident, illness, or other incapacity, regardless of whether I have authorized such expenses.

As a condition for the transportation received, I, for myself, my Participant, my executors and assigns, further agree to release and forever discharge International Sports Academy, LLC (“ISA”), and their agents, officers, employees, contractors and volunteers from any claim that I might have myself or that I could bring on my Participant’s behalf with regard to any damages, demands or actions whatsoever, including those based on negligence, in any manner arising out of this transportation.

I have read this entire waiver and authorization form, I fully understand its terms and conditions, and I agree to be legally bound by its terms.
