TERMS AND CONDITIONS

PLEASE READ CAREFULLY

PARTICIPANT HEALTH HISTORY
At Splash Fit Swim Club, our students’ mental and physical well-being are among our highest priorities. Participants with health concerns should consult a physician before beginning any physical activity.

Please disclose any current or previous health conditions, injuries, or physical limitations that could affect the participant’s ability to learn, safely participate, or fully engage in aquatic activities.

PARENT/GUARDIAN RESPONSIBILITIES

Children ages 17 and younger may not be left unattended at any facility where classes are held. A parent, guardian, or responsible adult must remain present at all times.

Our instructors and coaches are trained professionals. Distracting or interrupting an instructor or coach during class is not permitted. Parents and guardians should also avoid comparing their child’s progress with that of another participant. Every child learns at a different pace, and criticism can negatively affect a child’s confidence and development.

Participants should arrive focused, prepared, and ready to learn. Questions or concerns should be addressed with the instructor or coach before or after class, time permitting.

FACILITY RULES

All participants, parents, guardians, and guests must follow the rules of each facility to help ensure everyone’s safety. Please review the facility-specific rules and share them with your child and anyone accompanying the participant to lessons.

Shoes are not permitted on any pool deck. All participants must change in designated locker rooms. Changing on the pool deck is strictly prohibited unless designated changing tents or private changing areas are available.

CANCELATION & MAKEUP POLICIES

Please select classes that are compatible with your schedule. Frequent absences or late arrivals can disrupt instructional continuity, limit progress, and cause participants to fall behind.

Instructors and coaches are scheduled and compensated regardless of whether a participant attends. To qualify for a makeup token, an absence request must be submitted through the Splash Fit app or member portal at least 24 hours before the scheduled class.

Members may redeem up to one makeup token per month. Makeup tokens are subject to class availability and all applicable Splash Fit policies.

When Splash Fit Swim Club cancels a class, a makeup class will be provided at no additional cost. When a cancellation occurs because of an instructor or coach absence, facility closure, maintenance issue, or other unexpected circumstance, we will make every reasonable effort to notify affected members by phone, email, and text message as soon as possible.

Please understand that emergency cancellations may occur shortly before a scheduled class.

CONCUSSION AWARENESS-PREVENTION GUIDELINES

The following policies establish Splash Fit Swim Club’s concussion awareness and prevention procedures.

Splash Fit Swim Club, also referred to as “SFSC,” is committed to maintaining an effective concussion awareness and safety program. This program may include educational resources such as the online concussion training course offered by the Centers for Disease Control and Prevention.

SFSC communicates its concussion awareness and safety procedures in writing, including through electronic communications, to participants, coaches, parents, guardians, and other involved parties.

Our concussion awareness program focuses on:

  • Understanding concussions and their potential consequences

  • Recognizing concussion signs and symptoms

  • Responding appropriately to a suspected concussion

  • Preventing additional injuries

  • Preparing participants to return safely to activity after a concussion

Splash Fit Swim Club will take the following five steps when a concussion is suspected:

  1. Remove the participant from activity.

Look for signs and symptoms of a concussion after any bump, blow, or impact to the head or body. When in doubt, keep the participant out of the activity.

  2. Obtain a professional medical evaluation.

The participant should be evaluated by a healthcare professional who is experienced in assessing and managing concussions.

  3. Document information about the injury.

The following information may help healthcare professionals evaluate the participant:

    • The cause of the injury and the force of the impact to the head or body

    • Whether the participant lost consciousness and, if so, for how long

    • Whether the participant experienced memory loss immediately after the injury

    • Whether the participant experienced a seizure immediately after the injury

    • The number of previous concussions, if any

  4. Inform the participant’s parent or guardian.

The parent or guardian will be informed of the possible concussion and provided with concussion information. The participant should be evaluated by a healthcare professional who is experienced in assessing concussions.

  5. Keep the participant out of activity.

The participant may not return to activity on the day of the injury. The participant must remain out of activity until a qualified healthcare professional determines that the participant is symptom-free and provides clearance to return.

A second concussion that occurs before the brain has recovered from the first concussion can delay recovery and increase the risk of long-term complications. In rare cases, repeated concussions can result in brain swelling, permanent brain damage, or death.

BILLING AUTHORIZATION

I represent and warrant that, when purchasing a service from Splash Fit Swim Club, also referred to as “SFSC,” or from another merchant through SFSC:

  1. Any credit card, debit card, or bank account information I provide is accurate and complete.

  2. All charges incurred by me will be honored by my credit card company or financial institution.

  3. I will pay all charges at the posted prices, including any applicable taxes, fees, and penalties.

When I make an online payment or provide automatic payment information, I authorize Splash Fit Swim Club to charge the applicable credit card, debit card, or bank account through an Automated Clearing House, or ACH, transaction.

I understand that I am responsible for payment regardless of whether I or my student attends the scheduled classes.

Disputing an authorized charge through my financial institution may constitute a breach of contract and may result in penalties, additional fees, collection efforts, legal action, and the suspension or termination of current or future services.

LIABILITY/WAIVER & AUTHORIZATION

I authorize any representative of Splash Fit Swim Club to arrange for emergency medical treatment for the participant(s) in the event of an injury or medical emergency occurring during participation in aquatic activities under Splash Fit Swim Club’s supervision.

I waive, release, and forever discharge Splash Fit Swim Club; any facility in which its programs take place; and their respective shareholders, owners, members, directors, officers, agents, and employees, collectively referred to as the “Released Parties,” from any actions, suits, demands, claims, damages, attorneys’ fees, or causes of action arising out of or relating to the participant’s participation in aquatic activities offered by Splash Fit Swim Club or conducted at its program facilities.

I further agree to indemnify and hold harmless the Released Parties from claims arising from the participant’s participation in these activities.

I grant Splash Fit Swim Club permission to photograph or record the participant and to use those photographs or recordings for advertising, marketing, and promotional purposes.
