DRCS DELTA Roofing & Construction, LLC
By requesting interior remodel or restoration services from DRCS DELTA Roofing & Construction, LLC (“Contractor”), the client (“Client”) agrees to the following terms and conditions:
1. Authorization to Proceed
The Client affirms they are the legal property owner or an authorized representative with full authority to approve restoration work and enter into this agreement. The Client further confirms they have the authority to initiate and authorize payment for services rendered.
2. Scope of Work
DELTA Roofing & Construction will provide interior restoration, repair, or remodeling services as detailed in the written estimate or project proposal. Scope may include but is not limited to: drywall, flooring, painting, cabinetry, insulation, and electrical or plumbing repairs (performed by licensed trades as needed). No work will begin without written Client approval.
3. Insurance Claim Acknowledgment
If the Client has filed an insurance claim for damage related to the requested services:
The Client agrees to provide all documentation necessary for Contractor to coordinate with the insurance company, including claim number, adjuster contact information, and scope of loss.
The Client authorizes DELTA Roofing & Construction to speak with the insurance carrier or adjuster for purposes of verifying and discussing covered damages.
The Client remains responsible for any deductible, uncovered items, and amounts not paid by the insurer. Insurance proceeds must be paid directly to the Contractor or endorsed for payment upon disbursement.
Work will be performed in accordance with approved scope unless written change orders are signed.
4. Changes to Scope or Pricing
Any additional work or modifications outside the original scope must be requested and approved in writing. These changes may affect overall pricing and project timelines.
5. Access and Conditions
The Client agrees to provide DELTA Roofing & Construction reasonable access to the property during scheduled work hours and to ensure a safe working environment. The Contractor is not liable for delays due to inaccessibility, hazardous conditions, or third-party interference.
6. Payment Terms
Unless otherwise agreed in writing, payment is due upon completion of work or according to the milestones outlined in the contract. Late payments may be subject to interest, collection fees, or legal action. The Client agrees that final payment is due even if insurance funds are delayed, denied, or insufficient.
7. Warranty
Interior workmanship is covered by a 1-year limited workmanship warranty. Manufacturer warranties on materials or appliances will be passed directly to the Client when applicable. Warranty coverage excludes pre-existing damage or issues not related to the scope of services.
8. Liability and Damages
DELTA Roofing & Construction is not responsible for pre-existing conditions, concealed damage, or defects not visible at the time of inspection. The Contractor shall not be held liable for indirect, incidental, or consequential damages.
9. Cancellation
If the Client wishes to cancel the project after signing a contract, a written notice is required. Any materials ordered, work completed, or labor incurred up to the date of cancellation will be billed and payable in full.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising shall be resolved in a court of competent jurisdiction in the Contractor’s operating county.
Client Acknowledgment
By signing or authorizing service, I confirm that I have read, understood, and agree to the terms above. I further confirm that I am authorized to request and approve this work and will be responsible for payment under the agreed terms.
