This Program Participation & License to Occupy Agreement (hereby referred to as "Agreement") is entered into on the day of (select date below):
This agreement is entered into by and between Geneva's Garden of Grace, a nonprofit organization, operating, Nate's 2nd Chance Housing (hereby referred to as "Program"), and the undersigned individual ("Program Participant").
1. NATURE OF AGREEMENT - No Tenancy Created:
I understand that this is a background-friendly housing program. I understand that I am a member of this program, this is not a lease and not a Landlord/Tenant agreement, as defined by Arizona Revised Statutes Title 33.
This agreement grants me temporary and revocable license to occupy an assigned designated sleeping space. This does not create tenancy, possessory interest, or rights to the property, beyond the scope granted here.
2. PROGRAM PARTICIPATION & CONDITIONAL OCCUPANCY:
Participation in Nate's 2nd Chance Housing Program is VOLUNTARY & CONDITIONAL. Occupancy is only permitted if participant has been screened and approved, has an Acceptance Letter, remains in compliance with program rules and PAYS ALL PROGRAM FEES in FULL and ON TIME.
HOUSING IS NOT GUARANTEED and may be revoked at any time if participation requirements are not met.
3. LICENSE TERM:
The license to occupy begins on (select move-in date below): The license to occupy continues ONLY WHILE I remain compliant with this agreement. The program retain sole discretion to determine whether continued participation is appropriate
4. PROGRAM FEES (NON-NEGOTIABLE):
Program participation requires payment of mandatory, non-negotiable Program Fees.

Program Fee amount is $200 a week which includes all utilities. I understand that Program Fees are due in full, each Sunday, every week until my balance is paid in full, which is $800 a month.
A fee of $5 a day is added for each day that I am late. My full balance MUST be paid in full, in order to be in compliance and participating in meeting the program requirements.

A non-refundable le program fee is applied to each Participant for their 1st month. This program fee covers administrative costs and application processing. The Program Fee is $100.

6. IMMEDIATE REMOVAL & SAFETY TERMINATION:
The Program reserves the right to immediately revoke occupancy and remove a Participant for any reason related to safety, security, or program integrity, including but not limited to: Drugs or alcohol possession or use on or near the premises, refusal or failure to drug testing, violence or physical altercations, threats (verbal, written, or implied), harassment, intimidation, or aggressive behavior, creating a disturbance or unsafe living conditions, possession of weapons or contraband, criminal activity, endangerment of others, failure to comply with admin or managements directives. Immediate removal may occur without notice when safety concerns exist.
7. NON-PAYMENT & UNAUTHORIZED OCCUPANCY:
If Program Fees are not paid in full, as required, the license to occupy is revoked, continued presence constitutes unauthorized occupancy, and the Participant agrees to vacate immediately. The Program may issue written notice, but is not required to do so.
8. HOUSE RULES (CONDITIONS OF PARTICIPATION):
Compliance with the following House Rules is a mandatory condition of participation:
General Conduct: Maintain a respectful, safe, and cooperative environment. Follow all instructions issued by Program management, resolve conflicts peacefully, no theft or unauthorized use of others property, no loud or disruptive behavior, no entry into another Participant's sleeping area without permission, no display of explicit of inappropriate material in common areas.
Visitors & Confidentiality: No VISITORS, whatsoever, at all. DO NOT DISCLOSE the property location.
Substance Policy: ZERO TOLERANCE for illegal drugs or alcohol in or around house. Marijuana, if permitted, must be consumed off-property ONLY. Random drug testing is conducted and refusal or positive results will result in immediate removal.
Cleanliness & Responsibilities: Maintain personal hygiene, keep sleeping areas and common areas clean. Clean the kitchen and bathrooms immediately after use and participate in chores and household responsibilities.
Violation of any House Rule constitutes grounds for immediate revocation of occupancy.
9. LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION:
Participation involves shared living with other adults. The participant: assumes all risks associated with participation, acknowledges no guarantee of safety, releases the Program from liability for injury, loss, or damage, accepts responsibility for their actions and decisions, agrees to indemnify and hold harmless the Program from claims arising from their conduct.
10. NO GUARANTEE OF CONTINUED PARTICIPATION:
The program may revoke participation and occupancy at any time, with or without notice, if continued participation is deemed inappropriate.
11. GOVERNING LAW:
This Agreement shall be governed by and interpreted under the laws of the State of Arizona.
12. ACKNOWLEDGEMENT:
By signing below, the Participant acknowledges that you: are NOT a tenant, have no right to continued housing, is granted a revocable license ONLY, understand immediate removal may occur, and agree to all terms and conditions
