AUTHORIZATION – The undersigned, (Buyer) hereby authorizes Cape Cod Biofuels to deliver to the above address on an Automatic Delivery Schedule. (Buyer) understands and agrees that: (i) Seller shall not be responsible for failure to make deliveries due to conditions beyond its control, including but not limited to strikes, fires, accidents, inclement weather, acts of God, government regulations or fuel shortages; (ii) accurate fuel consumption rates must be established and Seller is not responsible for any fuel run-out or any damages resulting there from or incidental thereto; and, (iii) it is the Buyer’s responsibility to insure they have adequate fuel inventory on hand and Seller is not responsible for any fuel run-out or any damages resulting there from or incidental thereto. Buyer agrees to pay all costs of collection incurred by Seller in the enforcement of this agreement, including but not limited to, Attorney fees and expenses.
