These Terms & Conditions ("Terms") govern the services provided by LOC8 My Business ("LOC8," "we," "us") to the client named below ("Client," "you"). By signing the onboarding form, submitting payment, or accepting delivery of any work, you agree to these Terms.
1. THE SERVICES
1.1 LOC8 provides website design and development services for real estate professionals. These may include design, page building, copywriting, basic on-page setup, integrations, and related services as described in your onboarding form, proposal, or written agreement.
1.2 The specific service(s), pages, features, deliverables, and fees are set out in your onboarding form, proposal, or invoice. Anything not described there is not included unless separately agreed in writing.
1.3 Ongoing services — such as hosting, maintenance, software updates, security, backups, or content changes after launch — are only included if expressly stated in your proposal or a separate plan.
2. WHAT IS INCLUDED AND WHAT IS NOT
2.1 The project delivers the website described in your proposal. Work beyond that description — additional pages, features, redesigns, or revision rounds beyond those included — is a change request and may be quoted and billed separately (see Section 3.4).
2.2 Unless expressly agreed in writing, the project does not include: ongoing maintenance, security monitoring, backups, software or plugin updates, hosting, domain registration, email setup, content writing beyond what is stated, ongoing search engine optimization, or paid advertising.
2.3 Third-party services. Your website may rely on third-party platforms and tools (for example, hosting providers, domain registrars, a CMS or page builder such as Landinsite.ai or Wordpress or Bold Trail or GoHighLevel, themes, plugins, fonts, and integrations). These are governed by their own terms and fees, which are your responsibility. LOC8 is not responsible for third-party outages, changes, discontinuations, price changes, or data loss.
3. CLIENT RESPONSIBILITIES
3.1 Materials. You are responsible for providing the content, text, images, logos, branding, logins, and access LOC8 needs, in usable form and on a timely basis.
3.2 Accurate information. You are responsible for the accuracy of all information you provide and for verifying all facts and content before the site goes live — including address, hours, phone, license and brokerage details, pricing, and any claims.
3.3 Timely feedback and approvals. Project timelines depend on your prompt review, feedback, and approvals. Delays in providing materials or approvals will extend the timeline accordingly.
3.4 Revisions and scope. Your proposal states how many rounds of revisions are included. Requests beyond the agreed scope or the included revision rounds are billed separately at LOC8's then-current rates.
3.5 Lawful use. You are responsible for ensuring the website and its content comply with applicable law, including the Fair Housing Act, your state real estate advertising rules, your brokerage's requirements, and accessibility and privacy laws (see Sections 6, 7, and 8).
4. NO GUARANTEE OF RESULTS
4.1 LOC8 builds your website to a high professional standard, but does not and cannot guarantee any specific search ranking, traffic, lead volume, conversion rate, sales, or timeline for results.
4.2 Results depend on factors outside LOC8's control, including your market, your content and reputation, your ongoing marketing, third-party platforms, and changes search engines make to their algorithms and features.
4.3 Any timelines, benchmarks, or examples LOC8 shares are illustrations, not promises. Individual results vary.
5. LAUNCH, TESTING, AND POST-LAUNCH
5.1 Approval and launch. Before launch, you will review the site and confirm it is approved. Your approval — or the site going live — means it meets the agreed scope.
5.2 Compatibility. LOC8 builds for current, widely used browsers and devices. LOC8 does not guarantee identical appearance or function on every browser, device, version, or screen size, or on outdated software.
5.3 Bug-fix window. For [30] days after launch, LOC8 will correct functional defects in the work LOC8 delivered, at no charge. This does not cover new features, content changes, third-party issues, or changes made by you or others after handoff.
5.4 After handoff. Once the site is delivered or launched, changes, updates, security, and backups are your responsibility unless you are on a written maintenance plan.
6. ACCESSIBILITY
6.1 Website accessibility (for example, ADA and WCAG standards) is an evolving legal area. Unless your proposal expressly includes accessibility work to a stated standard, LOC8 does not warrant that the website meets any specific accessibility or legal standard.
6.2 You are responsible for determining your accessibility obligations and for ongoing accessibility as your content changes. LOC8 can provide accessibility work as a separately scoped service on request.
7. FAIR HOUSING AND ADVERTISING COMPLIANCE
7.1 Real estate advertising is regulated by the federal Fair Housing Act and by state and local law. Content LOC8 produces is written to describe places, services, and market facts — not people — and to avoid signaling any preference based on a protected class.
7.2 You are responsible for reviewing all website content against Fair Housing requirements, your state real estate advertising rules, and your brokerage's policies before publishing and on an ongoing basis. You are responsible for the compliance of what you publish.
8. CONTENT, PHOTOS, AND INTELLECTUAL PROPERTY
8.1 Your materials. You represent that any materials you provide (logos, headshots, photos, text, video) are owned by you or licensed to you, and that LOC8 may use them to perform the Services.
8.2 Photo and media rights. You are responsible for only using images, video, and media you own or have the right to use. Do not supply MLS photos, listing photos you did not take or license, or media taken from the internet. LOC8 is not responsible for third-party copyright or licensing claims arising from materials you supply or publish.
8.3 Third-party and stock assets. Any stock images, fonts, themes, or plugins used are subject to their own licenses. Licenses that must remain active — for example, premium plugins or subscriptions — are your responsibility to maintain after handoff.
8.4 Ownership of deliverables. On full payment, ownership of the final custom website design and the content LOC8 created specifically for you transfers to you. LOC8 retains ownership of its underlying methods, reusable code, templates, and proprietary processes, and of any third-party components (which remain under their own licenses). LOC8 may display the completed website in its portfolio and marketing unless you request otherwise in writing.
8.5 Client data and privacy. If your website collects visitor information, you are responsible for your own privacy policy, consent notices, and compliance with applicable privacy laws.
9. PAYMENT, BILLING, AND CANCELLATION
9.1 Fees and payment schedules are set out in your onboarding form, proposal, or invoice. Payment in full is typically due before work begins, with any other added balance due per the schedule in your proposal. Websites are not launched or handed off until all fees due are paid in full.
9.2 Recurring services (such as hosting or maintenance plans) are billed in advance and renew automatically until cancelled.
9.3 You may cancel a recurring service with [30] days' written notice to [email protected]. You remain responsible for any fees already billed for the current period.
9.4 Late or failed payments may pause work until resolved.
9.5 Inactive projects. If you do not provide needed materials, feedback, or payment for [30] days, LOC8 may pause or close the project. Deposits and fees for work performed are non-refundable, and restarting a closed project may require a new quote.
10. REFUNDS
10.1 Because website work is custom and produced specifically for you, deposits or any payments and one-time project fees are non-refundable once work has begun. Recurring service fees are non-refundable for the current period, but you may cancel future periods under Section 9.3.
11. TERM AND TERMINATION
11.1 These Terms begin on the effective date and continue until the Services are complete or the agreement is terminated.
11.2 Either party may terminate for a material breach that is not cured within [30] days of written notice. LOC8 may suspend or terminate Services for non-payment or for a request to act against applicable law or a third party's terms.
11.3 On termination, you will pay for all work performed up to the termination date. Files and deliverables are released once amounts due are paid.
12. LIMITATION OF LIABILITY
12.1 To the fullest extent permitted by law, LOC8's total liability arising out of or relating to the Services is limited to the amount you paid LOC8 for the specific service giving rise to the claim in the [three] months before the claim.
12.2 LOC8 is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost leads, lost data, lost rankings, downtime, or loss of business, even if advised of the possibility.
13. INDEMNIFICATION
You agree to defend, indemnify, and hold LOC8 harmless from claims, damages, and costs arising from: content or materials you supplied; content published on your website; your violation of applicable law (including Fair Housing, advertising, accessibility, or privacy law), a third party's terms, or these Terms; or third-party rights claims relating to images, media, or text you provided.
14. GENERAL
14.1 Independent contractor. LOC8 is an independent contractor, not your employee, legal business partner, or brokerage.
14.2 Not legal advice. LOC8 provides design and marketing services, not legal, compliance, accessibility, or brokerage advice. You are responsible for obtaining your own legal and regulatory guidance.
14.3 Governing law. These Terms are governed by the laws of Florida, without regard to conflict-of-law rules. Disputes resolved in the courts of Lee County, Florida.
14.4 Entire agreement. These Terms, together with your onboarding form and proposal, are the entire agreement between us and supersede prior discussions. LOC8 may update these Terms for future work; changes do not apply retroactively to work already delivered.
14.5 Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
15. ACKNOWLEDGMENT
By signing below (or by checking the acceptance box on the onboarding form), you confirm that you have read, understood, and agreed to these Terms, including the client responsibilities, the no-guarantee-of-results statement, the accessibility and third-party provisions, and the Fair Housing and advertising obligations.
