SAPNEIL TUTORING INC. AGREEMENT FOR PARENTS AND STUDENTS

This Agreement is made between Sapneil Tutoring Inc. ("Provider"), with the physical mailing addresses of:

1405 SW 107th Avenue, Suite 205 C Miami, FL 33174 and 12798 Forest Hill Blvd, Suite 302 Wellington, FL 33414

and satellite offices:

Coral Gables, Palm Beach, Boca Raton, Miami Beach, Aventura, Coral Springs, and Pinecrest

and:

1. Services to be performed
Provider (Sapneil Tutoring Inc) Coach will perform 6, 8, 10, 12, 14 or Premier ACT/SAT/ Study Skills/ Graduate Prep. or other session programs. Sapneil Tutoring Inc. Coach will provide proven instruction and strategies to the Student. Sapneil Tutoring Inc. strongly encourages the Student to diligently perform necessary assignments to optimize Student success. Sessions can range from 1-2 hours at the discretion of the tutor, office manager, and owner. Exam simulations can be done at Sapneil Tutoring office or at home. Skype/ Zoom/ Virtual Platform tutoring can be scheduled as part of the Premier Program at the discretion of the tutor, office manager, and owner. Premiere program is valid only for year it was applied on. Premier program can be applied to either SAT or ACT exams, but not both. Student must complete all assignment/exams to be eligible for further sessions.
2. Suggested Student Responsibilities
To achieve optimal success in ACT/SAT Private Tutoring Program Preparation Program, Sapneil Tutoring Inc. highly recommends that Students consistently follow the pertinent activities outlined below:
o Optimal nutrition within one hour of beginning each practice test as outlined in the Sapneil Tutoring materials.
o Other motivational strategies during and within one hour of beginning each practice test as well as proper animated and dynamic breaks during each practice test as outlined in the Sapneil Tutoring Inc. materials.
o Striving for a minimum of 80% compliance toward the overall techniques of the test such as circling answers, underlining key phrases, writing things out, crossing out or eliminating “incorrect answers,” and omitting relatively difficult questions as outlined in the Sapneil Tutoring Inc. Preparation materials.
o Striving for a minimum of 80% of vocabulary journaling assignments and vocabulary word recollection.
o The student is encouraged to be alert, energized, confident, and focused during each of the Sessions.
o The student must complete all Sessions of the Course (in-home/in-class/on-line).
3. Location of Services
Sapneil Tutoring Inc. will have all classes at the office location listed in the header and student should expect to be at this location for all tutoring sessions and exam simulations.
4. Cancellation of Session Policy
Under normal circumstances, Parent/Student must provide at least 48-hour phone/text notice of cancellation/rescheduling to Sapneil Tutoring Inc. /Educational Coach prior to a scheduled Session. Sapneil Tutoring Inc. /Educational Coach must also, under normal circumstances, provide at least 48-hour phone/text notice of cancellation/rescheduling to Parent/Student prior to a scheduled Session. If sufficient notice is not provided by the Parent/Student to Sapneil Tutoring Inc. Educational Coach, then the Session may be counted as one of the Sessions provided (certainly for a no-show or canceling within a few hours of the scheduled Session) and may not be made up or a $50.00 penalty fee may be assessed. If an emergency takes place to either party, phone/text notice must be given as soon as possible prior to a scheduled Session. A one-time emergency reschedule or cancellation will be granted without penalty.
5. Schedule Changes
Parents and students must complete a schedule availability form in which parent/student select preferred days and times for sessions according to parent/student availability. Once form has been completed and signed, Sapneil Tutoring will create a customized schedule based on parent/student preference. Schedules will be revised a maximum of 3 times to accommodate for student availability at the beginning of the program. Schedule changes will not be done after schedules have been completed and approved by parent/student.
6. Parent Responsibilities
During the time of a Coaching Session, a parent or guardian is recommended to be present and authorization is given to the student to attend the tutoring sessions solely via signature from this form. The Parent assumes responsibility if Student and Educational Coach are left alone during a Session (which includes the travel time, as needed by Student, just before and just after each Session). Parents are also encouraged to employ positive reinforcement whenever possible. In addition, it is highly recommended that the Parent proctor the Student during practice tests given at home. All appropriate materials and directions will be given to the student. Sapneil Tutoring Inc. highly encourages a triangular relationship between tutor/coach, student & parent for optimum success.
7. Materials
Sapneil Tutoring Inc session tutoring programs Coaching Services will furnish all proprietary and copyrighted Preparation Coaching Services, equipment and supplies used to provide the GRE Tutoring Program required by this Agreement for delivery to the Parent/Student. The materials include all course packets, schedules, evaluation forms, progress reports etc.
8. Authorization for late payment penalty/rescheduling fee penalty
Full payment must be made prior to the start of the first tutoring session. Sapneil Tutoring Inc. holds the right as granted by parent to authorize a charge of $25 payment penalty for late payments and also a standard $50 rescheduling fee for adjustments made to the schedule after a schedule has been established. To avoid rescheduling fees, one must reschedule 48 hours prior to session or simulation test. Owner’s discretion to waive the rights.
9. Confidentiality
Parent/Student acknowledges that it will be necessary for Sapneil Tutoring Inc. to disclose certain confidential and proprietary information to Parent/Student in order for Sapneil Tutoring Inc. Educational Coach to perform his/her duties under this Agreement. Parent/Student acknowledges that any disclosure to any third party or any misuse of this proprietary or confidential information from any Sapneil Tutoring Inc. Physical or virtual domain would irreparably harm Sapneil Tutoring Inc. Accordingly, Parent/Student will not disclose or use, either during or after the term of this Agreement, any Sapneil Tutoring Inc. Proprietary or confidential information
10. Applicable Law and Severability
The laws of the State of Florida, specifically Miami-Dade County, will govern this Agreement. If any provision or provisions shall be held to be invalid, illegal, unenforceable or in conflict with the law of any competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
11. Payments
Courses paid in full upon registration will result in a $25.00 discount. Otherwise, if opted for payment plan, all payments must be made according to the outlined invoice that was given and accepted prior to the acceptance of the tutoring schedule. The parent/student is fully responsible for the total amount listed invoice and cannot only attend classes at their discretion but are fully responsible for all the classes and the payments associated. If the parent/student decide to not attend the classes/tutoring sessions they are still responsible for the full-nonrefundable amount of the program. If payments are not made, then the Owner of Sapneil Tutoring Inc. holds the full right to revert the cost of the program to the full amount if not paid in full without any applicable discounts. All late payment’s/missed payments will result in a $25 late fee per payment penalty along with the outstanding balance/class payment due and will be assessed to the invoice balance. Please be advised that all credit/debit card charges incur 7% tax.
12. Renewal of Tutoring Program
All tutoring program rates are fixed for a period of 30 days. After that time period if renewal is not completed the rates are adjusted to the current hourly tutoring rate.
13. Tutoring Payment Requirement
All parents/students/guardians are required to pay the full amount of the tutoring program from initial signup date and placement of security deposit. Under no circumstances can a parent/student/guardian suspend the payment required in the tutoring program. All fees are non-refundable. The student can not stop payment on any tutoring program, once the agreement is signed and the schedule is complete the parent/student/guardian is obligated to follow the program.
14. Extracurricular and Alternate Activities
Under no circumstance will a schedule be re-done because of sudden extracurricular activities. The schedule for students is completed at the beginning of a tutoring program and then we allow for one class reschedule based on a special circumstance. Under no conditions can the tutor be assigned to a different schedule after it has been completed because of alternate activities. The tutoring center expresses the importance of these college, high school or graduate level exams and the importance they play in a student’s future and the tutoring program takes precedent.
15. Photo Waiver Completion
Granting permission to Sapneil Tutoring Inc. and its agents or employees, to use photographs taken of the student for use in university publications such as recruiting brochures, newsletters, and magazines, and to use the photographs on display boards, and to use such photographs in electronic versions of the same publications or on Sapneil Tutoring Inc. web sites or other electronic form or media, and to offer them for use or distribution in other non-university publications, electronic or otherwise, without notifying the student.

If student is signed up for off site classes there are no exceptions and no refunds for missed classes that are not rescheduled within 48 hours.
