🛥️ Reservation Terms, Bareboat Charter Disclosures & Acknowledgments

Important legal and operational information

Please carefully review each provision before submitting this form. These disclosures are intended to document the reservation, explain the responsibilities of the parties, and support compliance with applicable federal maritime and U.S. Coast Guard requirements.

⚓ Mandatory Reservation Verification

This form, the applicable charter agreement, government-issued identification, required signatures, waivers, payments, and other requested documentation must be completed before the reservation may be finally approved.

Completion of this form does not by itself guarantee departure. The charter remains subject to payment, document verification, vessel availability, regulatory compliance, and the captain's final safety determination.

⚖️ Federal Bareboat Charter Framework

Where the reservation is structured as a legitimate bareboat or demise charter, the charterer temporarily receives possession, command, and operational control of the vessel, subject to the written charter agreement and applicable law.

Title 46 of the United States Code contains federal laws governing vessels, passenger transportation, vessel safety, inspection, and maritime operations.
Title 46 of the Code of Federal Regulations contains U.S. Coast Guard regulations governing vessel inspection, certification, passenger-vessel operations, and related safety requirements.
46 C.F.R. § 175.110 addresses the applicability of federal small-passenger-vessel inspection rules, including certain charters involving more than 6 or more than 12 passengers, depending on whether the vessel owner provides or specifies the crew.
U.S. Coast Guard bareboat-charter guidance explains that a genuine bareboat charter gives the charterer possession and operational control of the vessel and the right to select the vessel's captain or crew.
A written agreement labeled “bareboat charter” does not establish compliance by itself. The actual conduct of the owner, charterer, captain, booking agency, and service providers must remain consistent with the charter arrangement.

By accepting these terms and submitting this form, I acknowledge and agree as follows:

Feeling Yachty's Limited Booking and Coordination Role
Feeling Yachty acts as an independent yacht-charter booking and coordination agency. Its role is limited to facilitating reservations, transmitting booking information, assisting with documentation, and coordinating communications among guests, independent vessel owners, operators, captains, marinas, and service providers.
Independent Vessel Ownership and Operation
Unless expressly stated otherwise in writing, Feeling Yachty is not the vessel owner, operator, captain, crew employer, vessel manager, insurer, common carrier, or transportation provider. Vessel ownership, seaworthiness, maintenance, insurance, documentation, licensing, equipment, and regulatory compliance remain the responsibility of the applicable independent vessel owner, operator, and captain.
Bareboat or Demise Charter Structure
Where applicable, my reservation will be conducted under a separate bareboat or demise charter agreement directly between me, as charterer, and the independent vessel owner or authorized operator. During the charter period, I understand that I am the charterer of the vessel and receive the rights and responsibilities stated in the applicable charter agreement.
Charterer's Possession and Operational Control
For a bareboat charter, I understand that the arrangement must provide me with possession, command, and operational control of the vessel for the charter period. The vessel owner and its representatives may not retain control in a manner inconsistent with a legitimate bareboat charter.
Right to Select a Qualified Captain and Crew
I understand that I have the right to independently select and engage a properly qualified captain and any required crew. I may choose from qualified available professionals or propose another qualified captain, subject only to lawful credential, insurance, safety, and vessel-qualification requirements.
No Required Owner-Supplied Captain
I understand that the vessel owner or the owner's representative may not require me to use one specific captain as a condition of a bareboat charter. Any captain list, contact information, or recommendation is provided for convenience and does not eliminate my right to make the final selection.
Captain's Independent Status
The captain and crew are independent maritime professionals engaged separately for the charter. Unless expressly stated in a separate written agreement, they are not employees of Feeling Yachty, and Feeling Yachty does not direct their navigation, vessel-operation, licensing, safety, or seamanship decisions.
Captain's Safety Authority
The selected captain has final authority over vessel navigation, passenger safety, weather assessment, route selection, speed, anchoring, swimming, water activities, intoxicated or unsafe passengers, and whether the charter may safely begin or continue. No guest, booking representative, vendor, or service provider may override the captain's lawful safety decision.
Passenger Capacity and Federal Inspection Rules
I understand that passenger limits depend on the vessel's certification, gross tonnage, inspection status, crew arrangement, and applicable federal requirements. A vessel operated under a bareboat charter without an owner-provided or owner-specified crew generally may not carry more than 12 passengers unless it holds the required U.S. Coast Guard inspection certification or another lawful authorization applies.
Accurate Guest Count
I am responsible for providing a complete and accurate guest count, including children where applicable. Undeclared guests or a guest count exceeding the vessel's authorized capacity may result in denied boarding, removal of guests, cancellation, or referral to a properly inspected vessel, without an extension of charter time.
Inspection and Law-Enforcement Cooperation
I understand that the vessel may be boarded or inspected by the U.S. Coast Guard, Florida Fish and Wildlife Conservation Commission, local marine patrol, or another authorized agency. I agree to cooperate and to keep the applicable charter agreement, identification, passenger information, captain credentials, and required documentation available during the charter.
Accuracy of Reservation Information
I certify that the charter date, departure time, vessel, guest count, contact information, services, and other reservation details are complete and accurate. I must report errors before payment or final confirmation. Locked, system-generated, or third-party booking details may not be changed without written authorization from the applicable parties.
Reservation Confirmation Requirements
My reservation is not finally confirmed until all required payments, identification, charter agreements, electronic signatures, acknowledgments, waivers, captain selection, and requested documentation have been received, verified, and approved.
Deposits and Advance Payments
Deposits, reservation payments, captain or crew reservation payments, and advance service payments are non-refundable except where a written cancellation policy, applicable platform policy, or controlling law expressly provides otherwise.
Arrival and Scheduled Charter Time
I understand that the charter begins and ends at the scheduled times. Late arrival by me or my guests does not extend the charter. Guest-caused delays may reduce available charter time and may cause scheduled services, water activities, catering, decorations, transportation, or other add-ons to be lost without refund.
Weather and Unsafe Conditions
Charters may operate during rain, clouds, wind, or ordinary weather changes when the captain determines conditions remain safe. If the captain or vessel owner determines that conditions are unsafe, the charter may be delayed, modified, rescheduled, credited, or handled under the applicable written charter and weather policies.
Routes, Destinations and Activities
Requested routes, destinations, anchorages, swimming areas, sandbars, sightseeing locations, and activities are requests only. They remain subject to charter duration, travel time, marine traffic, government restrictions, weather, water conditions, vessel limitations, and the captain's final safety determination.
Guest Conduct and Compliance
I accept responsibility for my conduct and the conduct of every person in my party. Guests must follow all lawful instructions from the captain and crew. Illegal substances, underage alcohol consumption, violence, harassment, reckless behavior, interference with vessel operation, and unsafe conduct are prohibited.
Damage and Extraordinary Cleaning
I may be financially responsible for damage, loss, excessive cleaning, prohibited-item disposal, or other costs caused by me or members of my party, subject to the applicable charter agreement and documentation of the loss or damage.
Independent Add-On Service Providers
Jet skis, water sports, transportation, catering, chefs, bartenders, DJs, photographers, videographers, decorators, marinas, and other optional services may be supplied by independent third-party providers. These services may require separate agreements, payments, waivers, identification, scheduling, licensing, safety briefings, or cancellation policies.
Scheduled Water-Sport and Add-On Services
I understand that jet skis and other third-party services may be reserved for a specific arrival time. Late arrival may prevent the provider from rescheduling or extending the service, and missed services caused by guest delay may not qualify for a refund.
Electronic Records and Communications
I consent to receive reservation-related emails, text messages, invoices, documents, reminders, marina information, check-in instructions, weather notices, schedule changes, and other important charter communications using the contact information I provide.
Electronic Signature and Agreement
By checking the acceptance box and submitting this form, I intend to provide my electronic signature. I understand that my electronic acceptance may be retained with the date, time, reservation information, and related electronic records as evidence of my agreement.

⚠️ Important Compliance Notice

Describing a reservation as a “bareboat charter” does not by itself establish a lawful bareboat charter. The written agreements and the actual operation must provide the charterer with the legally required control and captain-selection rights. Nothing in this form authorizes any vessel to exceed its lawful passenger capacity or operate without required licensing, credentials, insurance, safety equipment, or inspection certification.

⚖️ Marco Federal del Chárter Bareboat

Cuando la reserva se estructura como un verdadero chárter bareboat o demise, el arrendatario recibe temporalmente la posesión, mando y control operativo del yate, sujeto al contrato escrito y a la ley aplicable.

El Título 46 del Código de los Estados Unidos contiene leyes federales relacionadas con embarcaciones, transporte de pasajeros, seguridad marítima, inspección y operaciones.

Función Limitada de Feeling Yachty
Feeling Yachty actúa como una agencia independiente de reservas y coordinación. Su función se limita a facilitar reservaciones, transmitir información, apoyar con documentación y coordinar comunicaciones entre clientes, propietarios, operadores, capitanes, marinas y proveedores independientes.
Propiedad y Operación Independientes
Salvo que se indique expresamente por escrito, Feeling Yachty no es el propietario, operador, capitán, empleador de la tripulación, administrador, asegurador ni transportista del yate. La propiedad, navegabilidad, mantenimiento, seguro, documentación, licencias, equipo y cumplimiento corresponden al propietario, operador y capitán aplicables.
Estructura de Chárter Bareboat o Demise
Cuando corresponda, mi reserva estará sujeta a un contrato separado entre mí, como arrendatario, y el propietario u operador autorizado del yate. Durante el período del chárter, acepto los derechos y responsabilidades establecidos en dicho contrato.
Posesión y Control Operativo
En un chárter bareboat, entiendo que debo recibir posesión, mando y control operativo del yate durante el período contratado. El propietario y sus representantes no pueden conservar control de una manera incompatible con un verdadero chárter bareboat.
Derecho a Seleccionar Capitán y Tripulación
Tengo derecho a seleccionar y contratar independientemente a un capitán debidamente calificado y a la tripulación requerida. Puedo seleccionar profesionales disponibles o proponer otro capitán calificado, sujeto a requisitos legítimos de credenciales, seguro, seguridad y conocimiento del yate.
Ningún Capitán Específico Impuesto por el Propietario
El propietario o su representante no puede obligarme a utilizar un único capitán específico como condición de un chárter bareboat. Toda lista o recomendación de capitanes se proporciona por conveniencia y no elimina mi derecho de selección final.
Condición Independiente del Capitán
El capitán y la tripulación son profesionales marítimos independientes contratados por separado. Salvo acuerdo escrito distinto, no son empleados de Feeling Yachty, y Feeling Yachty no controla sus decisiones de navegación, seguridad o manejo del yate.
Autoridad de Seguridad del Capitán
El capitán seleccionado tiene autoridad final sobre navegación, seguridad, clima, ruta, velocidad, anclaje, natación, actividades acuáticas, pasajeros intoxicados o inseguros y sobre si el chárter puede comenzar o continuar de manera segura.
Capacidad de Pasajeros y Reglas de Inspección
Los límites de pasajeros dependen de la certificación, tonelaje, estado de inspección, estructura de tripulación y requisitos federales aplicables. Un yate operado bajo un chárter bareboat sin tripulación proporcionada o especificada por el propietario generalmente no puede transportar más de 12 pasajeros salvo que tenga la certificación de inspección requerida u otra autorización legal aplicable.
Número Correcto de Pasajeros
Soy responsable de proporcionar el número completo y correcto de pasajeros. Los pasajeros no declarados o un grupo que exceda la capacidad autorizada pueden ser rechazados, removidos o transferidos a una embarcación debidamente inspeccionada, sin extensión del horario contratado.
Cooperación con Inspecciones
El yate puede ser abordado o inspeccionado por la Guardia Costera, Florida Fish and Wildlife Conservation Commission, patrulla marina local u otra autoridad. Acepto cooperar y mantener disponibles los contratos, identificaciones, información de pasajeros, credenciales y demás documentos requeridos.
Exactitud de la Información
Certifico que la fecha, hora, yate, número de pasajeros, información de contacto, servicios y demás detalles son correctos. Debo reportar cualquier error antes del pago o confirmación final.
Requisitos de Confirmación
Mi reserva no estará finalmente confirmada hasta que todos los pagos, identificaciones, contratos, firmas electrónicas, exenciones, selección del capitán y documentos solicitados hayan sido recibidos, verificados y aprobados.
Depósitos y Pagos Adelantados
Los depósitos, pagos de reserva, pagos para reservar capitán o tripulación y pagos adelantados no son reembolsables salvo que una política escrita, política de la plataforma o ley aplicable establezca lo contrario.
Llegada y Horario Programado
El chárter comienza y termina a las horas programadas. Una llegada tarde no extiende el horario. Los retrasos del grupo pueden reducir el tiempo disponible y causar la pérdida de servicios programados.
Clima y Condiciones Inseguras
El chárter puede operar con lluvia, nubes, viento o cambios normales cuando el capitán determine que las condiciones son seguras. Si las condiciones son inseguras, el servicio podrá retrasarse, modificarse, reprogramarse o manejarse conforme a las políticas escritas aplicables.
Rutas, Destinos y Actividades
Las rutas, destinos, áreas de natación, anclajes y actividades solicitadas están sujetas a duración, tráfico marítimo, restricciones gubernamentales, clima, condiciones del agua, limitaciones del yate y decisión final del capitán.
Conducta de los Pasajeros
Acepto responsabilidad por mi conducta y la de mi grupo. Todos deben seguir las instrucciones legales del capitán y tripulación. Se prohíben sustancias ilegales, consumo de alcohol por menores, violencia, acoso, conducta temeraria e interferencia con la operación del yate.
Daños y Limpieza Extraordinaria
Puedo ser responsable por daños, pérdidas, limpieza excesiva o costos causados por mí o por miembros de mi grupo, sujeto al contrato aplicable y evidencia del daño o pérdida.
Proveedores Independientes
Motos acuáticas, deportes acuáticos, transporte, catering, chefs, bartenders, DJs, fotógrafos, decoradores, marinas y demás servicios pueden ser proporcionados por terceros independientes y requerir contratos, pagos, exenciones, identificación, licencias o instrucciones de seguridad separadas.
Servicios con Horario Reservado
Las motos acuáticas y otros servicios pueden reservarse para una hora específica. Una llegada tarde puede impedir que el proveedor reprograme o extienda el servicio, y el servicio perdido por retraso del cliente puede no ser reembolsable.
Comunicaciones Electrónicas
Autorizo el envío de correos, mensajes de texto, facturas, documentos, recordatorios, ubicación de la marina, instrucciones de registro, avisos del clima, cambios de horario y demás comunicaciones importantes utilizando la información que proporcione.
Firma Electrónica
Al marcar la casilla de aceptación y enviar este formulario, tengo la intención de proporcionar mi firma electrónica. Mi aceptación puede conservarse junto con la fecha, hora, información de reserva y registros electrónicos relacionados.

⚠️ Aviso Importante de Cumplimiento

Llamar a una reserva “chárter bareboat” no establece por sí solo un chárter legal. El contrato y la operación real deben otorgar al arrendatario el control y los derechos de selección del capitán requeridos. Este formulario no autoriza exceder la capacidad legal ni operar sin licencias, credenciales, seguro, equipo de seguridad o certificación de inspección requerida.
