Modern Human Fitness LLC | Universal Waiver & Release

1. Informed Consent & Risk Acknowledgment I (and/or my child, "the Participant") acknowledge that CrossFit and physical training at Modern Human Fitness LLC are strenuous "commercial activities." I am aware of the inherent risks, which include but are not limited to: muscle strains, rhabdomyolysis, cardiovascular complications (including heart attack or stroke), falls, equipment failure, and injuries caused by the negligence of other participants. I certify that the Participant is in good health and has no medical conditions that would limit participation.

2. Adult Release of Liability (For the Signer) In consideration of being allowed to participate, I hereby release and hold harmless Modern Human Fitness LLC, its owners, employees, and contractors from any and all claims or damages arising from my participation, INCLUDING THOSE ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. This release applies to all activities on the premises, surrounding areas (parking lots/sidewalks), or off-site locations, and is binding upon my heirs, assigns, and estate.

3. Minor Release of Liability (Fla. Stat. § 744.301) As the natural guardian, I waive and release all claims against Modern Human Fitness LLC for personal injury or death to my child resulting from the INHERENT RISKS of the activity. I acknowledge that I have read the mandatory Statutory Notice provided below.

4. 24/7 Access (Members Only) I understand 24/7 Access is unsupervised. I/the Participant access the facility at our own risk. Minors may only use 24/7 Access when accompanied by a parent/guardian. I agree to use equipment as intended, clean up after use, and never share access with non-members.

5. Media & Likeness Release I grant Modern Human Fitness LLC the irrevocable right to use the Participant’s name, image, and likeness in any media (including social media and website) for promotional purposes in perpetuity, without compensation. I waive the right to inspect or approve the finished product.

6. Indemnification, Venue, & Severability I accept financial responsibility for any injury or property damage caused by the Participant's negligent or intentional acts. Venue for any legal action shall be in Volusia County, FL. If any portion of this agreement is held invalid, the remainder shall continue in full force.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF MODERN HUMAN FITNESS LLC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM MODERN HUMAN FITNESS LLC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MODERN HUMAN FITNESS LLC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
