Terms and conditions

Welcome to the CDA Family! To help with clarity here are the basic terms and conditions that we operate regarding general club usage, annual membership, and monthly payments.

A few terms you will see and may need some clarification with are as follows:

CDA – Combined Defensive Arts

Student – the person who is registered and trains in classes

Guest – any family member, friend or legal guardian who picks up and drops off or stays to watch

CDA Rules:

Students and guests must comply with the CDA rules/etiquette.  If you are signing on behalf of a student as a parent/legal guardian, you are required to make the student aware of the CDA Rules.

1.    Students must attend classes in their CDA uniforms.

2.    Students and guests must be kind and courteous to parents, instructors and other students.

3.    Bullying will not be accepted in any form from students or guests.

4.    Displays of anger from students or guests will not be tolerated and may lead to expulsion from CDA.

5.    Displays of disobedience will not be tolerated and may lead to expulsion from CDA.

6.    Fees and memberships must be paid in accordance with our terms and conditions.

7.    Students must use the skills they are taught in a kind and responsible manner.

8.    Students involved in physical violence outside of CDA will need to explain their behaviour and may lead to expulsion from CDA.

9.    Students and guests must respect the training facility and equipment and not wilfully damage it in any way.

10. Guests using the waiting area must be respectful to others also using the waiting area and all children should be supervised closely at all times.

11. Noise levels from all guests and students in the waiting area should be kept to a reasonable level.

12. Students are not permitted on the mats outside of class times. Guests are not permitted on the mats at any time.

13. During classes, students are expected to keep all comments, jokes and language respectful and decent. Swear words, in any language, should not be used in the children's classes and kept to a minimum in the adult's classes (especially if being held downstairs next to the waiting area).

·         We may change the rules/etiquette at any time. We will post notice of any changes at the CDA premises. CDA may amend the CDA Rules from time to time in order to ensure the health and safety of members. Temporary amendments will be displayed at the CDA premises. Permanent changes to the CDA Rules will only be made after at least 30 (thirty) days' notice to members, except in the case of emergency.

·         CDA reserves the right to adjust the availability of certain facilities or close the CDA premises on a temporary basis for the general purpose of cleaning, decorating, essential repairs, maintenance of equipment, special functions and holidays.

Open Mat Training:

During hours where one set of mats are not being used, we offer open mat training to adult members only. During open mat training we expect all students to abide by the CDA Rules as above. Please also take note of the points below:

·         Please make sure you check the times open mat training is available before travelling.

·         We may occasionally have to cancel open mat training. All cancellations will be emailed and posted on the Facebook CDA Family group.

·         If asked to leave the mats by staff, please do so respectfully.

·         Open mat training is not supervised by an instructor so you are expected to keep yourself and others on the mats safe, not take risks that could lead to yourself or others being injured, and understand that there may be more risk of injury without an instructor.

Health & Safety:

Students and guests must read all Health and Safety notices displayed in the CDA premises and comply with their recommendations.

Children, guest or students, are not permitted to use the mats outside of class time and all children must be supervised closely in the waiting area by their parent or legal guardian.

Restriction of Liability:

·         CDA will not accept liability for any loss, damage to or theft of money, valuables or other personal property of members and guests. CDA also accepts no liability for any vehicles parked outside the facility.

·         Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by us.

·         CDA accepts liability for damage, accident, death, personal injury or other loss sustained by members or guests on the CDA premises to the extent caused by its negligence or the negligence of its employees and agents (during the course of their employment and agency, as appropriate) unless that failure is attributable to: a) Your own fault (b) A third party unconnected with our provision of services under this agreement or (c) Events which neither we nor our supplier could have foreseen or forestalled even if we had taken all reasonable care.

 

 

Facilities:

·         You are entitled to use the facilities available for your category of membership package.

·         You may have to pay additional charges to use certain other facilities/activities at the CDA premises.  We can change these prices at any time. 

·         CDA will close on all Bank Holidays.  We also close for 1 week during the summer holidays, 2 weeks over Christmas, and the Easter weekend (specific dates will be given annually). Notices will be displayed in the CDA premises in advance notifying customers of any changes. No refunds will be available for these periods. 

·         We may change the CDA premises opening times or withdraw any of the facilities at any time if we need them for events, tournaments, exhibitions or other special activities. 

·         We may need to close a facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. In the above circumstances we will use our best endeavours to give as much notice as is reasonably practicable by displaying notices in the CDA premises. 

·         Arrange for alternative facilities during a period of closure. 

Membership:

·         Membership is for a 12-month period and must be renewed annually.  We will message you when this is due and will be automatically taken via your direct debit.

·         Annual renewal prices can be found on the website or in the CDA premises.

·         Your membership will begin on the day you join.

·         Your membership is personal to you. You cannot transfer it to another person.

Fees:

·         CDA will set the level of fees and will review such fees periodically. CDA reserves the right to change the level of fees from time to time. For any changes to the monthly fee, we will give you at least 15 days’ written notice. The following fees prevail:

·         You must pay monthly training fees which will be determined by your chosen training package.

·         Monthly fees will be due on either the 1st or 15th of each calendar month or the next available working day by Direct Debit. 

·         Monthly fees are payable even if you do not use the CDA academy.

·         If you wish to amend your payment plan, we can do this at any time with 10 working days’ notice before your next payment date.

·         If CDA or the bank/building society makes a mistake with your direct debit payment you are guaranteed a full and immediate refund from your bank/building society.

 

 

Suspension of Membership:

·         Direct Debits can be paused upon agreement, for expected absences of longer than 2 months due to accident, illness, or financial difficulties.

·         For expected absences there must be a return date, if not then the membership will be cancelled and a re-join fee will need to be paid.

·         Membership will be lapsed if your Direct debit payment is cancelled – this will require a re-joining fee of £40 to set it back up again, and memberships will be at new prices not members old price.

·         Freezing of membership carries a £20 admin charge, for injury/illness there will be no charge.

·         To cancel your membership and monthly fees we require 10 working days’ notice from your payment date.  If it is too close to your payment to cancel the direct debit no refund will be issued, but you may continue to train for the next month.

·         With memberships of more than one person a 25% discount on training fees will be given to all family members after the person who has the highest payment plan.  If a family member was on a reduced rate and their family member leaves leaving them as the sole member, their payment plan will be changed to 100% with no discount.

Your club membership may be terminated by CDA in the following circumstances:

·         If you commit a serious or repeated breach of the CDA Rules and this is not REMEDIED within 7 (seven) days of receipt of a default notice; (If a member is expelled from CDA for inappropriate behaviour, the remaining membership fees are still payable in full)

·         If any part of your membership fee remains unpaid 30 (thirty) days after its due date for payment, or

·         If you provide us with details which you know to be false when applying for membership and the false declaration would have reasonably affected our decision to grant you membership.

POINT OF NOTE:

CDA undertakes sparring (controlled fighting) on a regular basis in Kickboxing, Street MMA, Juniors, and Little Ninjas children’s classes.


This will involve physical contact that could lead to injury.  Whilst we take every step necessary to prevent this (e.g., sparring safety equipment, gum shields, padded flooring, rule sets, supervision, correct pairings, verbalised rules of engagement prior to commencement) by signing this form you are accepting that you agree for this to take place.
