Waiver *

You acknowledge that there is a risk associated with participating in fitness activities and in exercising. Your use of Fitness Forum London’s Facilities and participation in any Fitness Forum London programming, including, without limitation, your participation in any in-club or online fitness classes or any of Fitness Forum London's Group Fitness Programs ("Group Fitness") is completely voluntary and you acknowledge that you are assuming all risks of injury to yourself or others including, without limitation, any illness (for example communicable diseases such as SARS, avian flu (H5N1), MRSA, influenza, and COVID-19) or medical condition, any physical or psychological injury, including but not limited to paralysis, death, damages, economic or emotional loss. Please raise any concerns about starting an exercise, sport or Group Fitness program with your physician before using the Facility and/or participating in Group Fitness. You further understand and acknowledge that your use of the showers in the Facility, including your use during such time that the Facility is not staffed ("Unstaffed Hours") is entirely at your own risk. Your use of the showers at all times is completely voluntary and you acknowledge that you are assuming all risks of injury to yourself or others. In consideration for being permitted to use the Facility and/or participate in Group Fitness programs, You agree on your own behalf, and on behalf of your heirs, executors, attorneys, administrators, representatives, spouse, children, estate trustees, successors and assigns to: (a) release, waive, indemnify and discharge Fitness Forum London, together with its owners, officers, directors, agents, employees, volunteers, representatives, sponsors, affiliates, business operators, independent contractors and site property owners or lessees (the "Released Persons"), from any and all claims or causes of action (known or unknown) which you may have arising out of your use of the Facility and/or your participation in Group Fitness programs, including, without limitation, use of the showers during Unstaffed Hours, and including, without limitation, those arising out of the negligence or gross negligence of a Released Person, breach of contract, breach of statutory duty of care, or mistake in error of judgment; (b) indemnify and save harmless the Released Persons from any and all actions, proceedings, claims, damages, losses, costs, demands, and liabilities of whatsoever nature or kind, including court costs on a solicitor and own client basis, brought against us by any party arising out of your actions, including, without limitation, your negligence, while at the Facility, while participating in any programs offered by the Facility, whether at the Facility, your residence or elsewhere, or while making use of the showers, including, without limitation, any use of the showers during Unstaffed Hours; (c) acknowledge that Fitness Forum London is not responsible for any damage to, loss or theft of your personal property; (d) agree to be contacted by phone or email regardless of Do Not Call registry status; (e) confirm that you have read, understood and agreed to this waiver freely and voluntarily, and acknowledge that by signing, you are waiving certain legal rights, including the right to sue the Released Persons.
