Release of Liability and Assumption of Risk
BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT AS WELL AS THE RIGHT OF YOUR PERSONAL REPRESENTATIVES TO COMPENSATION FOR YOUR DEATH.
PLEASE READ THOROUGHLY BEFORE SIGNING.
I agree that, in consideration of being permitted by City Fit Shop Inc., carrying on business as City Fit Shop, to use its equipment and facilities, which may be changed or renovated from time to time, including by participating in structured and unstructured games activities, and events (the “Permitted Activities”), now and in the future, I hereby agree as follows:
1. I acknowledge and understand that there are inherent risks, dangers and hazards involved in the Permitted Activities which may be foreseen, unforeseen, known or unknown, and I, by signing below, freely accept and fully assume all risks, dangers and hazards, including the possibility of personal injury, including paralysis, death, damage to property or third parties and all loss resulting from such risks, dangers or hazards;
2. I release and forever discharge City Fit Shop as well as all employees, volunteers, directors, officers, shareholders, agents, representative and all other persons, firms and corporations that may be acting for, in conjunction with, or on behalf of City Fit Shop (collectively the “Released Parties”) from any and all damages, claims, demands, causes of action, costs (on a solicitor and own client basis), and suits of any kind and nature that may in any way be connected with or related to the Permitted Activities or to the failure on the part of the Released Parties to safeguard or protect me from all foreseen and unforeseen, known and unknown risks, dangers and hazards in any way connected with or related to the Permitted Activities;
3. I agree that I will not sue or make any claim against City Fit Shop for damages or any other losses sustained in connection with or related to the Permitted Activities, including any injury, death or damage caused by or related to the negligence, omission, breach of contract, or other fault of the Related Parties;
4. I acknowledge and agree that the above assumption of risk, release from liability, covenant not to sue and hold harmless applies to my participation in the Permitted Activities on the date this Release is signed and on each and every subsequent date I attend at any City Fit Shop location, and has the same effect as if executed on each and every day I attend a City Fit Shop location;
5. This Release will be governed and interpreted according to the law in the Province of Alberta and I agree to submit to the exclusive jurisdiction of the Courts of the Province of Alberta;
6. I acknowledge and agree that all of the terms and conditions binding the parties are set out in this Release in their entirety. This Release is binding on my heirs, executors, assigns and administrators; and
7. I understand that my participation in the Permitted Activities is voluntary and that I do not have to sign this Release but can instead choose to not participate in the Permitted Activities. I have read over this Release carefully before signing it, and I understand its meaning. By signing this Release, I understand that I am waiving certain legal rights which I, or my personal representatives, may have against the Released Parties, and I sign this Release voluntarily.
8. I give full permission for any person connected with City Fit Shop to administer first aid deemed necessary for myself and in case of serious illness or injury, I give permission to call for medical and or surgical care for myself and to transport myself to a medical facility deemed necessary for the well-being of myself.
9. I hereby grant City Fit Shop , its assigns, licensees and legal representatives the irrevocable right to use my name/photograph/image/audio recording/video recording/ and likeness (“My Image”) in all forms and manner including but not limited to publication on Internet Web Sites, broadcasts and any other publications as released to or by City Fit Shop. I understand that City Fit Shop cannot control unauthorized use of My Image by persons not associated with City Fit Shop once My Image has been published. I hereby forever waive any right to inspect or approve any publication of My Image by City Fit Shop.
Parent's or Legal Guardian's Additional Agreement & Release
(Must be completed for participants under the age of 18)
In consideration of (the Minor/s)being permitted to participate in the Permitted Activities, I, the undersigned parent or legal guardian of the Minor agree on behalf of the Minor to all of the above terms, including the terms regarding the assumptions of risk, release of liability covenant not to sue and obligation to hold harmless the Released Parties from any and all claims, demands, causes of action, costs (on a solicitor and own client basis) and suites of any kind and nature which are brought by, or on behalf of the Minor, and which may in any way be connected with or related to the participation by the Minor in the Permitted Activities or to the failure on the part of the Released Parties to safeguard or protect the Minor from all foreseen and unforeseen, known and unknown risks, dangers and hazards in any way connected with or related to the Permitted Activities. I further certify that I am the parent or legal guardian of the Minor. I hereby grant my consent to the Minor participating in the Permitted Activities.
I hereby agree to be bound by the terms of this Release.
