Waiver of Liability, Release Agreement & Participant Agreement

This Waiver of Liability, Release Agreement & Participant Agreement ("Waiver") applies to your participation in The Slow Exhale women's wellness retreat, held October 8 to 11, 2026, in Soldiers Grove, Wisconsin ("the Retreat"). Please read this Waiver carefully and completely before signing electronically at the bottom of this form.

1. Parties Released

By signing this Waiver, I agree to release, waive, discharge, and covenant not to sue the following parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation in the Retreat:

Inspiring Actions LLC and its owner, Tracey Mortensen;
Any instructor, facilitator, practitioner, contractor, or staff member engaged by Inspiring Actions LLC or Tracey Mortensen to lead, teach, assist with, or otherwise support the Retreat, including but not limited to Angela Blackwood, yoga and sound healing, and Angie Balsimo-Stumpf, EFT tapping;
And the officers, directors, employees, volunteers, and agents of each of the above.

Collectively, these are referred to as the "Released Parties." This release applies to any injury, illness, death, property damage, or other loss that may occur before, during, or after the Retreat, except to the extent caused by the Released Parties' gross negligence or intentional misconduct where such a limitation is not permitted by Wisconsin law.

2. Assumption of Risk

I understand that the Retreat includes yoga and movement practices, sound healing sessions, and EFT, Emotional Freedom Technique, tapping sessions, along with related activities, meals, lodging, and free time at the retreat venue.

I understand that these activities carry inherent risks, including but not limited to physical exertion, muscle strain or soreness, falls, emotional or physical release during bodywork or energy practices, and risks associated with travel to and from, and staying at, a rural retreat property.

I understand that the retreat venue has its own separate liability waiver covering the property and its premises, and that this Waiver applies specifically to Inspiring Actions LLC, Tracey Mortensen, and the retreat leaders and staff.

I voluntarily choose to participate in the Retreat and all associated activities with full knowledge of these risks, and I voluntarily assume all such risks, known and unknown, whether or not described above.

3. Health & Physical Condition

I confirm that I am physically fit and have no medical condition that would prevent my safe participation in the Retreat, or that I have consulted with a physician and received approval to participate.

I agree to inform the Retreat leaders of any relevant physical, mental, or medical conditions prior to the start of the Retreat, and to use my own judgment about modifying or opting out of any activity that does not feel appropriate for my body.

4. Photo & Video Release

I grant Inspiring Actions LLC and Tracey Mortensen permission to photograph and/or video me during the Retreat and to use those images and recordings in print, digital, and social media for marketing and promotional purposes, without compensation to me.

If I prefer not to be photographed or recorded, I will notify the Retreat leaders in writing before the Retreat begins.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, costs, or expenses, including reasonable attorney's fees, arising out of my participation in the Retreat, to the extent permitted by Wisconsin law.

6. Registration, Payment, and Refunds

I understand that the $400 nonrefundable deposit is due upon registration and the total cost must be paid in full by September 15, 2026.
I understand if I have not paid my balance by September 15, 2026, my spot will be made available to other participants, and my $400 deposit will not be refunded.
I understand that if I choose to register without a roommate, but intend to find a roommate, I can register with a $500 non-refundable deposit that holds two spots. I understand it is up to me to find a roommate. If I don’t, I understand that I will be responsible for the full cost of a double room that will be paid in full by September 15, 2026.
I understand that my registration is only refundable, minus the deposit, if my spot is filled. If it is not filled, no refund is given. We will do our best to fill your spot. If you would like to sell your spot to someone you know, you may do so upon written notification.

7. Governing Law & Severability

This Waiver shall be governed by the laws of the State of Wisconsin. If any provision of this Waiver is found to be unenforceable, the remaining provisions will remain in full force and effect.

8. Acknowledgment

I have read this Waiver in its entirety. I understand it is a legally binding document that releases the Released Parties from liability to the fullest extent permitted by law, and I am signing it freely and voluntarily.

Electronic Signature

By typing my name below as my "electronic signature," I agree that it is the binding equivalent to my handwritten signature. I will not, at any time in the future, repudiate the meaning of my electronic signature or claim that my electronic signature is not legally binding.

I am of full legal age and have read and fully understand the terms of this Waiver of Liability, Release Agreement & Participant Agreement. I have been offered a paper copy of this release and prefer to complete this form electronically.
