Please read the following carefully. Hot air ballooning is a dangerous activity. This agreement includes important information and releases. Please ask us if you have any questions about this Agreement.

PARTICIPANT RELEASE

I, the undersigned, acknowledge that my participation in a tethered hot air balloon ride at Magic Over Murray, September 18–20, 2026 (the “Event”), held at Cottonwood High School, Murray, Utah, may subject me to possible hazards and risks. I understand that such hazards and risks include, but are not limited to: (a) loss of or damage to personal property; (b) bodily injury or death; (c) accident or illness in remote places without medical facilities; and (d) all risks explained to me before flying. I understand that large open areas are needed for the take-off and landing of the balloon and that such areas may be undeveloped, unimproved, and in an unsafe condition. I understand that the pilot is not a medical professional and cannot assess my physical or emotional condition. I have consulted my personal physician or taken whatever steps I deem necessary to determine that I am in good health with no conditions that might limit my participation in ballooning activities. I understand that no medical benefits will be provided to me during these ballooning activities and that I and/or my insurance shall be solely liable to pay for any medical expenses incurred on my behalf. In consideration of my being permitted to participate in the tethered balloon ride at Magic Over Murray, which includes riding in a hot air balloon, I by such participation agree to assume such hazards, risks, and conditions.

In consideration of my being permitted to participate, I do hereby waive, release, hold harmless, and forever discharge Murray City, Granite School District, Cottonwood High School, the Murray Chamber of Commerce, the Murray Chamber of Commerce Foundation, and the balloon pilots and crews participating in Magic Over Murray, and their respective officers, employees, agents, representatives, volunteers, and all others acting on their behalf from any and all claims, lawsuits, demands, causes of action known or unknown for any and all injury, illness, damage, or loss, including, but not limited to, death, that may occur to me or my personal property as a result of any aspect of my participation in Magic Over Murray and riding in a hot air balloon as part of the event.

I agree to defend and indemnify Murray City, Granite School District, Cottonwood High School, the Murray Chamber of Commerce, the Murray Chamber of Commerce Foundation, and their officers, employees, agents, representatives, and all others acting on their behalf, from and against claims or lawsuits for personal injury, bodily injury, death, or property damage, relating to my participation in Magic Over Murray.

I further expressly agree that the foregoing Participant Release and Waiver of Liability Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Utah. The undertakings and covenants of the foregoing provisions shall be binding upon me, my heirs, legal representatives, successors, and assigns.

I, THE UNDERSIGNED, HAVE READ AND VOLUNTARILY SIGNED THIS PARTICIPANT RELEASE AND WAIVER OF LIABILITY AGREEMENT, AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, PROMISES, OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE. I ASSUME ALL THE RISKS INHERENT IN PARTICIPATING IN THE MAGIC OVER MURRAY TETHERED BALLOON RIDE AND VOLUNTARILY SIGN MY NAME EVIDENCING MY ACCEPTANCE OF THE ABOVE PROVISIONS.

I certify that I am 18 years of age or older, or that I am the legal guardian and/or parent of the below-named minor participant with authority to sign this document on behalf of the below-named minor. If I am signing for a minor passenger, all waivers, releases, assumptions of risk, terms of agreement, representations, acknowledgments, and certifications apply equally to such minor.

PARENTAL CONSENT

I give my consent for my child/children listed below to participate in Magic Over Murray and ride in a hot air balloon, knowing the inherent risks associated with the activity. I do hereby release Murray City, Granite School District, Cottonwood High School, the Murray Chamber of Commerce, the Murray Chamber of Commerce Foundation, and their officers, employees, agents, representatives, and all others acting on their behalf from any and all liability, including, but not limited to, any and all loss, damage, personal injury, or claims my child or I may have as a result of my child’s participation in Magic Over Murray and riding in a hot air balloon.

I further release any and all said officers and other participants for any claims whatsoever on account of first aid treatment or service rendered to my child during or related to his/her participation in Magic Over Murray.
