LATE PICK-UP POLICY:

Late Pick-Up Policy: If your child is not enrolled in aftercare and remains on-site after pickleball ends, they must be picked up by 3:10 PM. One courtesy warning will be given. After that, a fee of $20 will be charged for every additional 5 minutes past 3:10 PM. This fee will be automatically billed to your credit card on file.

If a child remains in our care for more than one hour past the designated pick-up time, we are legally required to notify Social Services.

Please inform us in advance if you anticipate being late. Timely pick-up ensures the well-being of both your child and our staff.

REFUND POLICY:

Cancelations: National Pickleball Project is contingent upon the number of student registrations at each school. Expenses such as equipment fees, payroll, insurance, and school lease fees are calculated and paid upfront. Thus, all enrollments are final, and no refunds will be provided.

Make-up Classes: If your child misses any classes for personal reasons, no make-up classes will be offered for individual students. We cannot guarantee a make-up class if a class is canceled by the school for any reason. However, we will work with the school to try and schedule a make-up date. If a class is canceled due to National Pickleball Project, we will always arrange a make-up class, or if that is not possible, we will credit you for the missed class.

Behaviors / Disruption: In the rare event that a child becomes a disciplinary problem, continually disrupting classes and preventing coaches from instructing other students, the child may need to be permanently removed from the class. In such cases, no refunds will be issued.

WAIVER & RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND PUBLICITY AGREEMENT:

This Agreement is entered into by the undersigned parent(s) and/or legal guardian(s) on behalf of the minor participant (“Participant”), in consideration of being permitted to participate in any way in programs, activities, events, instruction, or use of equipment provided by CA Gratitude Operation LLC dba National Pickleball Project, the School Board of Palm Beach County, and any associated schools, facilities, or premises (collectively, the “Activities”).

1. Inspection, Safety, and Participation: I agree to instruct the Participant to inspect all facilities and equipment prior to participation. If the Participant believes any condition is unsafe, the Participant will immediately notify program officials and refuse to participate. If at any time I or the Participant believe conditions are unsafe, participation will immediately cease. I agree to comply with all stated rules and customary terms of participation. If I observe any concern regarding the Participant’s readiness or the program itself, I will immediately remove the Participant and notify the nearest official.

2. Equipment Responsibility: I accept any equipment used in connection with the Activities (“Equipment”) AS IS, with no warranties, express or implied. I understand that I am fully responsible for the care and proper use of the Equipment while in my possession. If at any time the Equipment appears unsafe or malfunctioning, I will immediately stop use and return it for inspection, repair, or adjustment.

3. Assumption of Inherent Risk: I understand and acknowledge that participation in athletic and recreational activities and the use of Equipment involve inherent risks and dangers. These risks include, but are not limited to: property damage, illness, bodily injury, broken bones, fractures, partial or total paralysis, heart attack, cognitive impairment, drowning, pain, suffering, emotional distress, permanent disability, and death. I understand that these risks may be caused by my or the Participant’s actions or inactions; the actions or inactions of others (including the Releasees); accidents; collisions; negligent rescue efforts; weather; terrain; natural or environmental conditions; facilities; Equipment condition; or other foreseeable or unforeseeable causes. I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Releasees, and accept full responsibility for any resulting loss, damage, injury, disability, or death.

4. Release, Waiver, and Covenant Not to Sue: On behalf of myself, the Participant, and our heirs, assigns, personal representatives, and next of kin, I hereby release, waive, discharge, relinquish, and covenant not to sue: The School Board of Palm Beach County, participating schools and facilities, including but not limited to: Del Prado Elementary School, Sandpiper Shores Elementary School, Waters Edge Elementary School, Sunrise Park Elementary School, CA Gratitude Operation LLC dba National Pickleball Project, their owners, directors, officers, employees, agents, volunteers, coaches, sponsors, service providers, successors, and assigns (collectively, the “Releasees”) from any and all claims, demands, actions, liabilities, losses, or damages, whether known or unknown, arising out of or related to: Participation in the Activities, use of any Equipment, the condition of any premises or facilities, any act, omission, negligence, or carelessness of the Releasees or third parties to the fullest extent permitted by Florida law.

5. Indemnification: I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, liabilities, damages, losses, costs, or expenses (including attorneys’ fees) arising out of or related to my or the Participant’s participation, even if caused in whole or in part by the negligence of the Releasees. If any claim is brought despite this Agreement, I agree to reimburse the Releasees for any amounts paid and all related expenses.

6. Medical Authorization and Financial Responsibility: In the event of an emergency and if I cannot be reached, I authorize program staff, volunteers, EMTs, physicians, hospital staff, or other qualified individuals to administer medical treatment deemed necessary for the Participant. I accept full financial responsibility for all medical costs resulting from participation. I represent that the Participant has been deemed physically fit by a pediatrician to participate. I agree to notify instructors in writing of any temporary medical restrictions.

7. Right of Publicity and Media Release: I grant the Releasees the irrevocable right to photograph, record, and/or videotape me and/or the Participant and to use, edit, reproduce, distribute, and display our name, image, likeness, voice, and appearance in any media now known or later developed, worldwide and in perpetuity, for promotional, advertising, educational, or commercial purposes, without compensation or further approval. I agree to indemnify and hold harmless the Releasees from any claims arising from such use. The Releasees are under no obligation to use any such materials.
