By electronically signing this form, the participant and/or parent or guardian agrees that they have read this waiver, understand the terms set forth herein and knowingly and voluntarily agree to the terms of this waiver. In consideration of my involvement in the program under the auspices of the Topline Soccer (and/or its officers, volunteers, staff, sponsors, agents, members, and/or activity participants) I hereby agree that:  

I acknowledge that by participating in any event put on by Topline Soccer training by its very nature:  

1. I RISK BODILY INJURY, INCLUDING PARALYSIS, DISMEMBERMENT, OR DEATH. While the particular rules of the sport, equipment, personal training and discipline may reduce this risk. The risk of injury does exist, as does the risk of damage to or loss of property.  

2. I knowingly and freely assume all risks both known and unknown, even if arising from negligence of the above mentioned parties. 

3. I willingly agree to comply with the stated and customary terms and conditions for participants, if however I observe any unusual or unnecessary hazard during my presence or participation, I will bring these incidents to the immediate attention of the nearest Topline Soccer Training Staff.  

4. For myself, and on behalf of my heirs, those assigned as a personal representative and my next of kin, I hereby: Release, Indemnify and hold harmless and agree not to sue, file a claim for relief or otherwise take legal action against Topline Soccer, their officers, volunteers, staff, or sponsors. Further I and/or my parent/guardian Releases from liability of any of the aforementioned from any liability from any and all injury and loss arising from my participation, whether caused by negligence or otherwise, except that which is the result of gross negligence or wanton misconduct. This indemnification shall include the payment of Topline Soccer’s reasonable attorney’s fees in defense of any claim filed by you.  

5. I grant Topline Soccer, its representatives, and employees the right to take photographs and videos of my child in connection with the above identified subject. I authorize Topline Soccer, its assigns, and transferees to copyright, use and publish the same in print and/or electronically. I agree that Topline Soccer may use such photographs and videos of my child with or without their name for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

6. By consuming any food or beverage provided by Topline Soccer, the consumer acknowledges and agrees to the following. I understand and acknowledge that the consumption of food and beverages may carry a risk of illness, allergic reactions, foodborne illness (including but not limited to salmonella, E. coli, listeria), or other adverse health effects. I voluntarily assume full responsibility for any risk of illness, injury, or loss that may arise from my consumption of any food or drink provided.

7. Child Pickup Responsibility. By enrolling a child in programs or classes provided by Topline Soccer, the parent or legal guardian ("Client") agrees to the following. I understand and agree that I am solely responsible for ensuring that my child is picked up promptly at the conclusion of each practice or class. I acknowledge that Topline Soccer, its staff, volunteers, and affiliates are not responsible for supervising my child beyond the scheduled end time of any session. If someone other than myself will be picking up my child, I agree to notify Topline Soccer in writing (email or text message) at least one (1) hour prior to the scheduled start time of that class or practice. I understand that failure to provide timely notice may result in refusal to release my child to any individual other than myself or those previously authorized in writing. I hereby release and hold harmless Topline Soccer, its staff, directors, agents, and representatives from any and all claims, liabilities, or damages arising out of or related to the pickup or release of my child, including but not limited to situations where I fail to provide adequate or timely notice regarding alternate pickup arrangements.
