Assumption of Risk: I understand and accept that renting any equipment rented by Ride It Baby Bikes, LLC and participating in these activities exposes me to many hazards and entails the unavoidable risk of death, personal injury, and loss of or property damage. I also understand I should be in good physical health to participate in these activities. I choose to participate despite these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising from renting any equipment. I understand the inherent risk involved in using this equipment, and I accept full responsibility for all such damage or injury which may result. I also understand how to operate a bicycle or e-bike or any equipment rented to me by Ride It Baby Bikes, LLC. Ride It Baby Bikes, LLC staff have answered any questions before I rent this equipment. I understand these bicycles do not have visibility enhancement equipment such as reflectors or lights, and I take full responsibility for any injuries or damage to property.

Waiver & Release: In consideration of Ride It Baby Bikes, LLC renting me this piece of equipment, I release and forever discharge Ride It Baby Bikes, LLC and its owners, officers, agents, and employees from all liability or claims for injury, illness, death, or loss of or damage to property which I may suffer while renting and participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death, or damage caused by the negligence of Ride It Baby Bikes, LLC. It is my intent by the Waiver and Releases Agreement to release Ride It Baby Bikes, LLC and hold harmless from all liability for any such property loss or damage, personal injury, or loss of life, whether caused by the negligence of Ride It Baby Bikes, LLC, or whether based upon breach of contract, breach of warranty, or any other legal theory.

Compliance: In signing this document, I realize the importance of wearing a helmet, and I hereby commit to comply with local and state laws regarding the use of a helmet for my safety. I also recognize that Ride It Baby Bikes, LLC is not responsible for providing a helmet. In the case of injury or death, I forever discharge them from all liability. In signing this document I agree to the following: NEVER ride on the same side of the road as oncoming traffic, NEVER carry a passenger, this bicycle or e-bike is designed for single rider only, NEVER hang item(s) over the handlebars, this could interfere with steering or catch in the front wheel causing a crash, NEVER hold on to another motor vehicle or bicycle, and NEVER ride too close to another vehicle. In signing this document I fully commit to obeying traffic rules when riding on public roads, never jumping, racing, performing stunts, or abusing the equipment, and never riding under the influence of intoxicating drugs or alcohol.

Theft and damage to property: In the case of a damaged bike, electric bike, part, equipment, or any other item or property that belongs to Ride It Baby Bikes, LLC, I take full financial responsibility by paying what was damaged if no coverage was added to my order. I will pay the full price plus taxes and shipping of any part or parts that need to be replaced regardless of whether the part is lightly scratched, bent, dented, or damaged. All rentals, equipment, and parts must be fixed to the same conditions as they were renting. I understand that prices will vary and that Ride It Baby Bikes, LLC will not accept my recommendations, “better price” options, or my input on how and what should be replaced. Ride It Baby Bikes, LLC will replace any damaged parts with the same parts through their partners, own sources, and their own discretion. Failure to comply with these terms and conditions, I understand and accept that Ride It Baby Bikes, LLC is in their right to file a lawsuit for damage to business property and failing to comply with a legal and binding agreement. In the case of a stolen bicycle or e-bike, whether intentionally or by accident or any other circumstance, I take full responsibility for the equipment and agree to pay 100% of the total cost of the equipment that I rented the same day of the incident either by card, cash, Zelle, check, or bank transfer. If coverage was purchased in my rental, Ride It Baby Bikes, LLC will cover 100% of the damages to any bike, electric bike, part, equipment, or any other item or property that belongs to Ride It Baby Bikes, LLC. If coverage was purchased and bike, electric bike, part, equipment, or any other item or property that belongs to Ride It Baby Bikes, LLC was stolen, Ride It Baby Bikes, LLC will cover 50% of the total cost of the item that was stolen and I, the renter, will cover the other 50%.

Advertising Agreement: By signing this document, you agree to receive promotional SMS or emails from Ride It Baby Bikes, LLC daily, weekly, or monthly. You will have an option to unsubscribe at any moment.

In the case of having a minor in the party, by signing, I agree that I am their parent or legal guardian and am releasing Ride It, Baby Bikes LLC from any claims, lawsuits, or responsibilities for that minor. Each undersigned has read this AGREEMENT FOR USE OF THE EQUIPMENT AND RELEASE AND WAIVER OF LIABILITY.

I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY, AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
