Sync Home Concierges - Contractor Terms of Service

Welcome to the Sync Home Concierges network. These Terms of Service ("Agreement") govern your participation in our network and your use of our platform. By joining our network, you agree to these terms.
1. Our Role as a Curator and Facilitator
Sync Home Concierges is a platform that curates and facilitates connections between homeowners and independent, third-party professionals. We are not a licensed contractor, and we do not perform, manage, or supervise any home improvement work. Our service is to provide pre-qualified project opportunities to you. The ultimate responsibility for bidding on, contracting, and completing any work is solely yours.
2. Your Role and Responsibilities
As an independent contractor in our network, you agree to:
Maintain Credentials: Keep all necessary state and local licenses (e.g., CCB in Oregon), insurance, and bonding current and active at all times.
Professional Conduct: Respond to homeowner inquiries and service requests in a timely and professional manner.
Communication & Updates: Provide reasonable and timely updates to Sync on the status of all projects referred through our platform, including:
Whether you have submitted a quote to the homeowner.
Whether you have been hired for the job.
When the job is completed.
When you have received full payment from the homeowner.
3. "True Performance Marketing" Fee Structure
Sync Home Concierges operates on a "True Performance Marketing" model. Your fee is based on successful, completed projects, not on leads or quotes.
No Upfront Fees: There are no fees to join our network or to receive project opportunities.
Success-Based Fee: You agree to pay Sync Home Concierges a marketing fee only after you have completed a job referred through our platform and have received full payment from the homeowner.
Fee for Repeat Business: Our marketing fees and terms remain in effect for a period of two years for any repeat business you secure with a client referred by Sync, regardless of whether our concierge service is used for the subsequent job.
Sliding Scale: The marketing fee is a percentage of the final, total job cost, applied on a transparent, sliding scale:
10% for jobs under $10,000
9% for jobs $10,000 - $20,000
8% for jobs $20,000 - $30,000
7% for jobs $30,000 - $40,000
6% for jobs $50,000 - $100,000
5% for jobs $100,000 - $150,000
4% for jobs $150,000 - $200,000
3.5% for jobs $200,000+
Invoicing & Payment: Invoices for the marketing fee will be emailed to you directly upon confirmation of job completion and payment from the homeowner. Payment is due within 7 days of the invoice date and can be made online via credit card, debit card, or ACH transfer.
4. Our Network & Reputation
The power of the Sync network lies in our shared commitment to integrity and trust. We rely on your ability to deliver 5-star service to build our collective reputation, which is key to everyone's success.
Referrals from Professional Partners: Sync may refer you to other professional partners (e.g., real estate brokers, attorneys, inspectors) who then refer clients to you. These referrals are also considered "referred by Sync" and are subject to the same marketing terms and conditions for a period of two years.
Prioritizing Sync Customers: A good brand reputation is a compounding asset. We ask that you prioritize Sync customers and treat every client with the professionalism and care they expect. A satisfied client enhances our reputation and drives more leads to everyone in our network.
5. Disclaimers and Limitation of Liability
No Guarantee of Work: Sync Home Concierges provides opportunities but does not guarantee that you will be hired for any specific job.
Limitation of Liability: In no event shall Sync Home Concierges be liable for any indirect, incidental, or consequential damages. Our liability, if any, will not exceed the marketing fee received for the specific service provided.
6. Hold Harmless and Dispute Resolution
Hold Harmless Agreement: You agree to and shall hold harmless, indemnify, and defend Sync Home Concierges, its owners, employees, and agents from any and all claims, damages, liabilities, or losses arising out of or in connection with your work performed for any homeowner referred through our platform.
Review Policy: You agree that no negative reviews may be posted on any public platform (e.g., Google, Yelp, social media) based upon the quality of the opportunities provided by Sync Home Concierges.
Dispute Resolution: In the event of any dispute or potential litigation arising from or related to our services, all parties agree that the first route of reasonable resolution shall be mediation.
7. Governing Law
This Agreement is governed by the laws of the State of Oregon.
8. Amendments
We reserve the right to modify these terms at any time. The most current version will be posted on our website.
