In consideration of being allowed to enter and/or use the facilities, equipment, and participate in activities at Zoey's Adventureland, the undersigned acknowledges, appreciates, and agrees to the following:
1. Assumption of Risk
I understand that participation in activities at Zoey's Adventureland involves inherent risks of injury, including, but not limited to, falls, collisions, equipment failure, and other hazards. I acknowledge that these risks are a part of play and I voluntarily assume full responsibility for myself, my child(ren), and any other minors under my supervision while participating in these activities.
2. Waiver and Release of Liability
I, for myself, my child(ren), and any other minors under my supervision, and on behalf of our heirs, personal representatives, and assigns, do hereby release, waive, discharge, and agree not to hold liable Zoey's Adventureland, its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, injuries, or causes of action that may arise from participation in activities or use of the facility, including negligence on the part of the released parties.
3. Indemnification
I agree to indemnify and hold harmless Zoey's Adventureland, its owners, employees, agents, and affiliates from any and all claims, demands, losses, or liabilities, including legal fees, arising out of or related to my participation or the participation of my child(ren) or any minors under my supervision in the activities offered at the facility.
4. Medical Treatment Authorization
In the event of an injury or medical emergency involving myself, my child(ren), or minors under my supervision, I authorize Zoey's Adventureland to seek and obtain appropriate medical care on my behalf, and I agree to bear the costs of such medical treatment.
5. Compliance with Rules and Supervision
I agree to adhere to all posted rules and instructions provided by Zoey's Adventureland staff. I understand that failure to comply with these rules may result in removal from the facility. I acknowledge that it is my responsibility to supervise my child(ren) and any minors under my care while using the facility.
6. Photographic Release
I grant Zoey's Adventureland permission to use photographs or videos taken of me, my child(ren), or minors under my supervision for promotional purposes, without compensation or further consent.
7. Severability
If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to be in full force and effect.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
