These Terms and Conditions (“Terms”) govern all bookings for Cabo San Lucas Fishing Charters 2026 operated by The Unfiltered Traveler, LLC, including trips marketed under The Unfiltered Outdoorsman (collectively, the “Company”). By submitting a deposit or payment, you (“Client,” “Participant,” or “Booking Party”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Booking Structure & Group Size

1.1 Charter Type: These Terms apply to private, full-boat fishing charter bookings.

1.2 Maximum Participants: A maximum of six (6) participants per charter.

1.3 Pricing Basis: Pricing is fixed based on a six-participant charter, regardless of the number of participants attending.

1.4 Booking Party Responsibility: The individual or entity initiating the booking (“Booking Party”) accepts full financial responsibility for the total charter cost and compliance with all deadlines and requirements.

2. Payments & Pricing

2.1 Deposit Requirement: A non-refundable deposit equal to 25% of the total charter cost is required at the time of booking to secure the reservation.

2.2 Deposit Priority: Reservations are confirmed on a first-come, first-served basis upon receipt of the deposit.

2.3 Final Payment Deadline: The remaining balance is due no later than 90 days prior to departure.

2.4 Payment Schedule: Incremental payments may be made prior to the final payment deadline.

2.5 Failure to Pay: Failure to remit payment by required deadlines may result in automatic cancellation of the booking and forfeiture of all payments made.

2.6 Pricing Changes: Pricing is non-negotiable and subject to change until the deposit is received.

3. Cancellations, Refunds & Transfers

3.1 Deposit: All deposits are strictly non-refundable under any circumstance.

3.2 Cancellations by Client:

• Cancellations made more than 90 days prior to departure may be eligible for a refund of payments made excluding the deposit.

• No refunds will be issued for cancellations made within 90 days of the trip start date.

3.3 Airfare: Airfare is subject to airline policies. The Company is not responsible for airfare changes, cancellations, delays, or missed connections.

3.4 Transfers: Participant substitutions or transfers are not guaranteed and are subject to approval by the Company.

4. Participant Information & Documentation

4.1 Participant Details: A complete list of participant names and passport details must be submitted no later than 30 days prior to arrival.

4.2 Failure to Provide Information: Failure to submit required participant information by the stated deadline may result in cancellation without refund.

4.3 Passport Validity: Passports must be valid for at least six (6) months beyond the trip start date.

4.4 Visas: Some nationalities may require a visa to enter Mexico. It is the participant’s sole responsibility to confirm and obtain any required visas.

4.5 Traveler Responsibility: Participants are responsible for maintaining valid travel documents and ensuring eligibility for international travel.

5. Eligibility, Health & Fitness

5.1 Age Requirement: Participants must be at least 18 years old unless accompanied by a legal guardian.

5.2 Physical Requirements: Deep-sea fishing is physically demanding and involves inherent risks. This trip is not suitable for individuals with limited mobility or requiring wheelchairs.

5.3 Medical Fitness: Participants should consult a medical professional prior to booking. Participation is voluntary and at the participant’s own risk.

5.4 Vaccinations: No vaccinations are required for U.S. citizens; participants should consult their healthcare provider regarding travel health precautions.

6. Travel Insurance (Mandatory)

6.1 Coverage Requirement: Comprehensive travel insurance is mandatory for all participants and must include coverage for medical emergencies, evacuation, trip interruption, and trip cancellation.

6.2 Proof of Coverage: Proof of valid insurance must be submitted prior to departure.

6.3 Non-Refundable: Travel insurance premiums are non-refundable.

7. Inclusions & Exclusions

7.1 Included:

• Four (4) nights’ accommodation in a private 3-bedroom condo at Portofino Pedregal (or similar)

• Two (2) full days of guided fishing with an English-speaking professional guide

• Two (2) boxed breakfasts

• Two (2) boxed lunches during fishing days

• Bottled water

7.2 Not Included:

• International airfare

• Airport transfers

• Additional meals or beverages not specified

• Personal expenses

• Mandatory travel insurance

8. Itinerary & Operational Changes

8.1 Flexibility: Itineraries are subject to change due to weather, sea conditions, safety concerns, or operational requirements.

8.2 Fishing Schedule: Final fishing plans will be determined with the captain on the day of departure.

9. Code of Conduct

9.1 Behavior Standards: Participants are expected to behave respectfully toward crew, guides, fellow participants, and local communities.

9.2 Prohibited Conduct: Illegal substances, unsafe behavior, or disruptive conduct may result in immediate removal from the boat and/or trip without refund.

10. Flights & Arrival

10.1 Booking Responsibility: Participants are responsible for booking their own international flights unless expressly arranged by the Company.

10.2 Arrival Guidance: Recommended arrival times and logistics will be provided in advance.

11. Liability & Assumption of Risk

11.1 Assumption of Risk: Participants acknowledge that deep-sea fishing involves inherent risks, including but not limited to rough waters, equipment-related injuries, marine wildlife encounters, and adverse weather.

11.2 Release of Liability: By participating, clients voluntarily assume all such risks.

11.3 Third-Party Providers: The Company is not liable for the acts or omissions of third-party service providers, including airlines, captains, guides, or accommodation providers.

12. Right to Terminate Relationship

12.1 Company Discretion: The Company reserves the right, at its sole discretion, to terminate the client-agent relationship or remove any participant from the trip at any time, for any reason, including but not limited to non-compliance with these Terms, disruptive behavior, safety concerns, or failure to meet payment or documentation requirements.

12.2 Effect of Termination: In the event of termination, the Company shall have no obligation to provide refunds, reimbursements, or alternative arrangements.

13. Modifications to Terms

13.1 The Company reserves the right to amend or modify these Terms at any time prior to the final payment deadline. Written notice will be provided.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which The Unfiltered Traveler, LLC is registered, without regard to conflict of law principles.

By submitting payment, the Booking Party and all participants confirm acceptance of these Terms and Conditions in full.
