LOL KIDS CLUB LIABILITY WAIVER, RELEASE, ASSUMPTION OF RISK & ARBITRATION AGREEMENT

WHO THIS AGREEMENT COVERS

By signing this Agreement, I certify that I am at least eighteen (18) years of age and that I am signing on behalf of myself and any minor child(ren) listed by me below or otherwise associated with my visit.

This Agreement applies to all current and future LOL Kids Club locations, programs, events, activities, memberships, camps, parties, and services for twelve (12) months from the date signed.

1. ASSUMPTION OF RISK

I understand that active play, recreational activities, and participation at LOL Kids Club involve inherent risks that cannot be completely eliminated, including but not limited to:

• Falls, slips, trips, and collisions

• Running, climbing, jumping, sliding, crawling, and other physical activities

• Injuries caused by play equipment, fixtures, surfaces, or other participants

• Sprains, strains, fractures, cuts, bruises, abrasions, concussions, paralysis, and other injuries

• Exposure to communicable illnesses, viruses, bacteria, or infections

• Risks arising from the actions of other guests, participants, or third parties

I voluntarily assume all risks, known and unknown, associated with participation at LOL Kids Club for myself and, to the fullest extent permitted by law, the minor child(ren) under my supervision.

I certify that I and the children in my care are physically capable of participating and do not have any condition that would make participation unsafe.

2. SUPERVISION AND SAFETY RULES

A responsible adult (18 years of age or older) must supervise minor children at all times.

I understand that LOL Kids Club is not a daycare, childcare facility, or babysitting service unless expressly stated in writing for a specific program.

I agree not to leave any child unattended unless LOL Kids Club has specifically designated a supervised drop-off program and accepted responsibility in writing.

I acknowledge that LOL Kids Club does not replace or supplement my duty to supervise children in my care.

3. FACILITY RULES

I agree that I and the children in my care will:

• Follow all posted rules and staff instructions

• Wear socks in all designated play areas

• Remove shoes where required

• Use equipment only as intended

• Behave respectfully toward guests and staff

I understand that LOL Kids Club may remove any guest who engages in unsafe, disruptive, abusive, threatening, or inappropriate conduct.

Removal from the facility for rule violations may occur without refund.

4. HEALTH, ILLNESS & COMMUNICABLE DISEASES

I agree that I and the children in my care will not enter the facility if experiencing symptoms of illness, including but not limited to:

• Fever

• Vomiting

• Diarrhea

• Persistent cough

• Difficulty breathing

• Any known contagious condition

I understand that LOL Kids Club cannot guarantee that exposure to illness, including COVID-19 or other communicable diseases, will not occur.

I voluntarily assume all risks associated with exposure to illness or infection.

5. RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS LOL KIDS CLUB, ITS OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, STAFF, CONTRACTORS, AFFILIATES, SUCCESSORS, ASSIGNS, LANDLORDS, AND AGENTS ("RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, COSTS, EXPENSES, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO:

• Use of the facility

• Participation in activities

• Attendance at events

• Property damage

• Personal injury

• Illness or infection

• Death

• Actions of other guests or third parties

This release does not apply to claims arising from the gross negligence or willful misconduct of the Released Parties where prohibited by law.

6. EMERGENCY MEDICAL AUTHORIZATION

In the event of an emergency involving a minor child under my supervision, I authorize LOL Kids Club staff to seek emergency medical assistance when reasonable efforts to contact me are unsuccessful or circumstances require immediate action.

I accept responsibility for all resulting medical expenses.

7. WEAPONS, DRUGS & PROHIBITED CONDUCT

LOL Kids Club is a family-focused facility.

The following are prohibited:

• Illegal drugs, narcotics, or unlawful controlled substances

• Drug paraphernalia

• Intoxication or impairment affecting supervision or safety

• Threatening, violent, abusive, harassing, or disruptive behavior

• Weapons or dangerous items prohibited by applicable law

LOL Kids Club reserves the right to deny admission, remove guests, suspend memberships, terminate reservations, or contact law enforcement when management reasonably believes a violation has occurred.

No refunds will be provided for violations of facility policies.

Admission to LOL Kids Club is a revocable license and may be revoked at any time for safety, security, operational, or policy-related reasons.

8. LOST OR STOLEN PROPERTY

LOL Kids Club is not responsible for lost, stolen, or damaged personal property.

Guests are solely responsible for their belongings.

9. PHOTO & MEDIA CONSENT

I hereby grant LOL Kids Club, along with its parent organization, affiliates, and authorized licensees, the absolute right and permission to take photographs and audio/visual recordings of both myself and my child (if applicable). These materials may be utilized for any lawful purpose, including but not limited to marketing, publicity, and advertising campaigns. This authorization applies to any media format or distribution channel currently existing or developed in the future, worldwide and in perpetuity. Furthermore, I relinquish any right to review, inspect, or approve the finished product, any modifications made to it, or its final application. I also acknowledge that these rights are granted entirely without financial compensation or royalty obligations.

10. FOOD, OUTSIDE ITEMS & DECORATIONS

No outside food, beverages, snacks, or drinks are permitted beyond admission areas except as specifically approved by LOL Kids Club.

Approved birthday celebrations may include cake, cupcakes, cake pops, and approved party favors.

Glitter, confetti, unsafe decorations, open flames, hazardous items, and prohibited party equipment are not allowed.

11. NO REFUND POLICY

ALL SALES ARE FINAL.

Admissions, memberships, party reservations, event bookings, gift cards, and services are non-refundable and non-transferable except where required by applicable law.

Nothing in this Agreement waives any rights that cannot legally be waived.

12. INJURY REPORTING

In the event of any injury, accident, or incident, I agree to notify LOL Kids Club staff as soon as reasonably possible and, whenever practicable, before leaving the premises.

I understand that video surveillance footage may not be retained indefinitely and that delayed reporting may limit investigation opportunities.

13. ARBITRATION & DISPUTE RESOLUTION

Any dispute, claim, or controversy arising from or relating to this Agreement, my visit, my child(ren)'s participation, any injury, illness, property damage, or any interaction with LOL Kids Club shall be resolved exclusively through final and binding individual arbitration administered by JAMS or, if unavailable, the American Arbitration Association (AAA) under applicable consumer arbitration rules.

I waive any right to a jury trial or court proceeding except as required by law.

Class Action Waiver

All disputes shall be brought individually.

I waive any right to participate in any class action, collective action, representative action, or multi-plaintiff proceeding.

Arbitration Authority

The arbitrator shall have exclusive authority to determine the interpretation, applicability, enforceability, and scope of this arbitration provision.

Governing Law

This Agreement shall be governed by the laws of the state in which the LOL Kids Club location I am visiting is located.

Severability

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

14. ELECTRONIC SIGNATURE & ACKNOWLEDGMENT

By signing electronically, I acknowledge and agree that:

• I have read and understand this Agreement in its entirety

• I am at least eighteen (18) years of age

• I have had sufficient opportunity to ask questions and seek independent legal advice if desired

• I voluntarily agree to all terms contained herein

• I understand this Agreement contains an Assumption of Risk, Release of Liability, and Binding Arbitration Agreement

• I am the parent, legal guardian, or otherwise authorized adult responsible for any minor children listed by me

• I am authorized to execute this Agreement on behalf of those minors to the fullest extent permitted by law

• LOL Kids Club is relying upon my representations in permitting participation
