About You

This is coaching, not therapy.

By typing your name, you are acknowledging understanding of and agreement with the contract following: I understand that executive, life, and leadership coaching is a collaborative process focused on personal growth and goal achievement. I acknowledge that life coaching is not therapy, counseling, or medical treatment, and does not replace these services.

COACHING AGREEMENT & INFORMED CONSENT

This Coaching Agreement (hereafter referred to as “The Agreement”) constitutes a contract between Dr. Kyrstin Coaching, LLC (hereafter referred to as “The Coach”) and the person who is named above (hereafter referred to as “The Client” or “You”) with an effective date as of the date of your signature below (“Start Date”). As The Client, you should read it carefully and raise any questions and concerns that you may have before you sign it.

Services: The services provided by Coach include Coaching or TeleCoaching on topics decided jointly with you, The Client and Dr. Kyrstin Coaching LLC.  At Dr. Kyrstin Coaching, our work together begins with a comprehensiveinitial sessiondesigned to explore you or your organization's unique goals, life transitions, and the path forward. Following that, for individual work, there will be90-minute client success sessionand then ongoing 60-minute sessionswill be completed providing consistent support, tools, and strategies tailored to your needs. As your coaching journey evolves, you’ll also have the opportunity to participate ingroup coaching sessions, creating a supportive space to learn, share, and grow alongside others navigating similar life stages and transitions.

The purpose of coaching is to provide objectively “healthy” individuals with guidance, accountability, education, and support, to pursue and achieve desired goals. This means that if you meet criteria for a diagnosis according to the Diagnostic and Statistical Manual of Mental Disorders 5 (DSM 5), we will not focus our work on that diagnosis and you may be referred out to a counselor for additional support.

I, The Coach, adopt The International Coach Federation’s definition of coaching quoted in part which is as follows:

Professional Coaching is an ongoing professional relationship that helps people produce extraordinary results in their lives, careers, businesses, or organizations. Through the process of coaching, clients deepen their learning, improve their performance, and enhance their quality of life.

In each meeting, the client chooses the focus of the conversation, while the coach listens and contributes observations and questions. This interaction creates clarity and moves the client into action. Coaching accelerates the client’s progress by providing greater focus and awareness of choice. Coaching concentrates on where clients are now and what they are willing to do to get where they want to be in the future. Coaches recognize that results are a matter of the client’s intentions, choices, and actions, supported by the coach’s efforts and application of the coaching process.

You can expect that your Coach will be honest and direct, asking straightforward questions and using challenging techniques to help you move forward. You are expected to evaluate your own progress; and, if the coaching is not working as you wish, you should immediately inform me, your Coach, so that we can both take steps to correct the problem. As with any human endeavor, coaching can involve feelings of discomfort and frustration which may accompany the process of change. Coaching does not offer any guarantee of success.

Psychotherapy, on the other hand, is a healthcare service. Its primary focus is to identify, diagnose, and treat nervous and mental disorders. The goals include alleviating symptoms, understanding the underlying personality dynamics that create symptoms, changing the dysfunctional behaviors that are the result of these disorders, and helping patients cope with their psychological problems. While psychotherapy may be reimbursable through health insurance policies, Coaching services, at present, are not.

The Coach reserves the right to terminate this Agreement, cancel pending Sessions, and/or assess late fees and penalties if Client willfully becomes delinquent on his/her payment plan without explanation.

Feedback: If, at any time, you, The Client, feel that your needs are not being met or you are not getting what you want out of the coaching or training group, please reach out to the Coach at your earliest convenience, so we can discuss your needs and adjust your coaching program, as needed.

Call Procedure: If The Client opts to attend sessions by phone, The Coach will call The Client at the pre-arranged time and telephone number as scheduled, and The Client will pay the telephone charges for the call, if international or additional fees are applicable. For group coaching calls and classes, The Coach will pay for the teleconference line, and The Clients will pay for the call into the conference line, if applicable.

Cancellations: For individual Coaching clients, you must give forty-eight (48) hours prior notice if you need to cancel or change the time of an appointment, otherwise you will be charged for the session in full. The Coach will make reasonable efforts to reschedule sessions that are canceled promptly.

Attendance and Continuation Policy:  Consistency and commitment are key to achieving meaningful progress in the coaching process. To ensure the best possible outcomes and maintain fairness in scheduling, clients are expected to attend all scheduled sessions or provide timely notice if rescheduling is required.

Clients who reschedule or miss three (3) consecutive coaching sessions will become ineligible to continue services. After the third consecutive rescheduled or missed session, any remaining appointments will be canceled, and the coaching agreement may be considered complete.

Clients who wish to resume coaching after services are discontinued may be required to initiate a new coaching agreement and will be scheduled based on current availability.

This policy is in place to support accountability, protect scheduling integrity, and ensure that coaching time is reserved for clients who are fully engaged in the process.

Termination: Either party may terminate the coaching relationship for any reason by providing the other party with a one-week written notice, which may be transmitted by email ([email protected]).

Confidentiality: As a licensed professional counselor, it is my duty to protect the confidentiality of the communications with my clients, including my coaching clients. The support staff of Dr. Kyrstin Coaching includes individuals who provide administrative support and are trained in the HIPAA requirements for confidentiality. I, The Coach, will only release information about our work to others with your written permission or if I am required to do so by a court order. There are some situations in which I am legally obligated by Federal and State laws to breach your confidentiality in order to protect others from harm, including the following: (1) If I have information that indicates that a child, elderly or disabled person is being abused, I must report that to the appropriate state agency; and; (2) If a client is an imminent risk to him/herself or makes threats of imminent violence against another person, I am required to take protective actions. These situations rarely occur in coaching practices, but if such a situation does occur, I will make every effort to discuss it with you before taking any action.

Some sessions are conducted in groups, including teleconference groups. You, The Client, agree to maintain the confidentiality of all information communicated to you by other coaching clients and by your Coach. It is understandable that progress is often enhanced when clients discuss their coaching relationship with trusted colleagues and friends. You can have these discussions with trusted colleagues and friends, but you agree not to share any information that would allow others in the group to be identified.

The Client should be aware that it is impossible to protect the confidentiality of Client information which may be transmitted electronically, i.e., electronic mail and other information stored on computers connected to the internet, by cordless or mobile telephones and similar telecommunication and computer equipment. Therefore, it is agreed between The Client and The Coach that unless The Client utilizes encryption and other forms of security protection, The Client waives any action legal or otherwise against The Coach and holds The Coach harmless for any interception of Client information resulting from the use of the above-mentioned equipment.

If you choose to write a testimonial or review for Dr. Kyrstin Coaching, please know that you NEVER need to disclose WHY you decided to get coaching with me, what we worked on particularly, or any other details that you do not feel comfortable sharing.  You may choose to only disclose how you felt with Dr. Kyrstin, other coaches, comment on their knowledge, communication, encouragement, and professionalism or any other such things that you found important to you in the process.  One of our main goals is to always make sure that you feel seen, heard, and understood.

Medical Disclaimer - Not Psychotherapy

In addition to being a Coach, Dr. Kyrstin is  also a licensed professional counselor (LPC)  in the State of Georgia with training and experience in diagnosing and treating emotional and psychological problems. Although there are some similarities between Coaching and psychotherapy, I, as The Coach, will not conduct psychotherapy. Coaching and psychotherapy are different modalities of counseling, and it is important that you as The Client understand the differences between them.

Although both Coaching and psychotherapy utilize knowledge of human behavior, motivation, behavioral change, and interactive counseling techniques, there are major differences in the goals, focus, and level of professional responsibility.

It is understood and agreed to by The Client and The Coach that if either of us recognizes that you, The Client, have a problem that would benefit from psychotherapy, I, The Coach, may refer or direct you to appropriate resources in addition to or in lieu of Coaching.

The client understands that results are not guaranteed. While many of Coach’s past and current clients have experienced wonderful benefits from the Program, and Coach and his/her team will act in their full capacity to ensure all clients are successful and happy in the Program, Coach cannot guarantee results of the Program, and cannot make any representations or guarantees regarding individual results. Client will hold Coach and Program harmless if he or she does not experience the desired results.

Client agrees at all times to defend, fully indemnify, and hold Coach and any affiliates, agents, team members, or other party associated with Coach harmless from any causes of action, damages, losses, costs, or expenses incurred as a result of Client’s use of Program, as well as any third-party claims of any kind (including attorney’s fees) arising from his/her actions as a direct or indirect result of Client’s participation in Program. Should Coach be required to defend herself in any action directly or indirectly involving Client, or an action where we decide Client’s participation or assistance would benefit Coach’s defense, Client agrees to participate and provide any evidence, documents, testimony, or other information deemed useful by Coach, free of charge.

Mutual Nondisclosure: The Coach and The Client mutually recognize that they may discuss The Client’s future plans, business affairs, customer lists, financial information, job information, goals, personal information, and other private information. The Coach will not voluntarily communicate The Client's information to a third party. In order to honor and protect the Coach's intellectual properties, The Client expressly agrees not to disclose or communicate any proprietary information about the Coach's practice, materials, or methods to any third parties. The Coach and The Client agree to be bound by this mutual nondisclosure agreement during and after the termination of the Coaching relationship.

Dispute Resolution: It is agreed between The Client, his or her assigns, family, and estate, and The Coach that any controversy or claim arising out of or relating to The Agreement, or the breach of this agreement, shall be settled by arbitration by an accredited individual or organization with an arbitrator whom we mutually agree upon. And, the arbitration may occur by telephone.

Your signature below, as The Client, acknowledges that you have read the information contained in The Agreement and Informed Consent; and indicates your assent to the terms of The Agreement; and signifies your assurance that you will abide by its terms during our professional Coaching relationship. The parties to The Agreement will hold duplicate originals of this document which have been signed and dated by both parties.

This Is Coaching, Not Therapy

By typing your name, you acknowledge that you understand and agree to the agreement that follows. You understand that career, life, and leadership coaching is a collaborative process focused on personal growth and goal achievement. You acknowledge that coaching is not therapy, counseling, or medical treatment, and does not replace these services.

Parties and Effective Date

This Coaching Agreement ("the Agreement") is a contract between Dr. Kyrstin Coaching, LLC ("the Company") and the person named in the signature block below ("the Client" or "you"). It takes effect on the date of your signature ("Start Date").

The Pivot Path™ is co-led by Dr. Kyrstin Lokkesmoe, PhD, LPC, and Elizabeth Oates (each a "Coach" and together "the Coaches"). Elizabeth Oates serves as an independent contractor of the Company for the Program. Both Coaches deliver services under this Agreement on behalf of the Company. Your contract, payment, and any questions about this Agreement are with the Company.

You must be 18 or older to enroll. Please read this Agreement carefully and raise any questions before you sign.

Group sessions are held on dates and times announced at enrollment. They provide structured content, discussion, and peer support with others navigating a similar career transition. Group sessions are psychoeducational and skills-focused; they are not group therapy or process groups.

Individual sessions are scheduled directly with each Coach. They focus on topics you and that Coach decide together, related to your career transition goals. Both individual sessions must be scheduled and completed within the Program Period. Sessions not used by the end of the Program Period are forfeited.

Additional individual coaching beyond what is listed above is not included in the Program fee and may be purchased separately under a separate agreement.

Purpose and Nature of Coaching

The purpose of coaching is to provide objectively "healthy" individuals with guidance, accountability, education, and support to pursue and achieve desired goals. If you meet criteria for a diagnosis under the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition (DSM-5), our work will not focus on that diagnosis, and you may be referred to a counselor for additional support.

The Coaches adopt the International Coaching Federation's definition of coaching, quoted in part:

Professional Coaching is an ongoing professional relationship that helps people produce extraordinary results in their lives, careers, businesses, or organizations. Through the process of coaching, clients deepen their learning, improve their performance, and enhance their quality of life.

In each meeting, the client chooses the focus of the conversation, while the coach listens and contributes observations and questions. This interaction creates clarity and moves the client into action. Coaching accelerates the client's progress by providing greater focus and awareness of choice. Coaching concentrates on where clients are now and what they are willing to do to get where they want to be in the future. Coaches recognize that results are a matter of the client's intentions, choices, and actions, supported by the coach's efforts and application of the coaching process.

You can expect the Coaches to be honest and direct, asking straightforward questions and using challenging techniques to help you move forward. You are expected to evaluate your own progress. If the coaching is not working as you wish, tell a Coach right away so we can correct the problem. Coaching can involve discomfort and frustration that may accompany change. Coaching does not guarantee success.

Coaching Compared With Psychotherapy

Psychotherapy is a healthcare service. Its primary focus is to identify, diagnose, and treat mental health disorders. Its goals include relieving symptoms, understanding the underlying dynamics that create symptoms, changing behaviors that result from these disorders, and helping patients cope with psychological problems. Psychotherapy may be reimbursable through health insurance. Coaching services currently are not.

Dr. Kyrstin Lokkesmoe is a licensed professional counselor (LPC) in the State of Georgia, with training and experience in diagnosing and treating emotional and psychological problems. Elizabeth Oates does not hold a mental health license or credential. In the Program, neither Coach will conduct psychotherapy. Coaching and psychotherapy both draw on knowledge of human behavior, motivation, behavioral change, and interactive techniques, but they differ in goals, focus, and level of professional responsibility.

If either you or a Coach recognizes that you have a concern that would benefit from psychotherapy, the Coach may refer you to appropriate resources in addition to, or instead of, coaching.

Feedback

If at any time you feel your needs are not being met in the group or individual sessions, contact a Coach as soon as possible so we can discuss your needs and adjust your coaching as needed.

Fees and Payment

The Program fee is $499, due in full at enrollment unless a written payment plan has been agreed to. The fee covers all three group sessions and both individual sessions.

If you are on a payment plan and become delinquent without explanation, the Company may end this Agreement, cancel pending sessions, and/or assess late fees.

Refunds. The Program fee is non-refundable. If you withdraw before the first group session, your fee may be applied to a future Pivot Path™ cohort.

Session Logistics

All sessions are held by Zoom. You are responsible for a reliable internet connection, a device with camera and audio, and a private space where you will not be overheard. The Company provides the Zoom links. If you choose to join by phone, you are responsible for any carrier or international charges.

Cancellations and Missed Sessions

Group sessions run as scheduled whether or not you attend. Missed group sessions cannot be made up and are not refunded. Any handouts or materials for a missed session will be provided to you.

Individual sessions require at least forty-eight (48) hours' notice to cancel or reschedule. A session canceled with less notice, or missed without notice, is considered used. The Coach will make reasonable efforts to reschedule sessions canceled with proper notice, within the Program Period.

If a Coach must cancel a session, that session will be rescheduled. If it cannot be rescheduled within the Program Period, it will be held as soon as possible after the Program Period ends.

Attendance

Consistent attendance is key to meaningful progress. You are expected to attend all group sessions and to schedule both individual sessions early in the Program Period. Unused individual sessions expire at the end of the Program Period.

Termination

You may withdraw from the Program at any time by written notice to [email protected]. Withdrawal does not entitle you to a refund except as stated under Refunds.

The Company may end your participation by written notice if you violate the group confidentiality or conduct terms of this Agreement, fail to pay, or if a Coach determines that your needs are better served by another type of service. In that case, the Company will provide referrals where appropriate.

Confidentiality

The Coaches protect the confidentiality of communications with Program clients. Dr. Kyrstin Lokkesmoe, as a licensed professional counselor, applies that same standard to her coaching clients. Elizabeth Oates follows the same confidentiality practices described in this section, including the limits on disclosure and the safety-related exceptions, and is bound by a written confidentiality agreement with the Company. Administrative staff of the Company are trained in confidentiality practices.

Information about your work in the Program will be released to others only with your written permission or when required by court order. The Coaches may share information with each other as needed to coordinate your Program services.

Some situations legally require breaking confidentiality to protect others from harm, including: (1) information that a child, elderly person, or disabled person is being abused, which must be reported to the appropriate state agency; and (2) a client who is an imminent risk to themselves, or who threatens imminent violence against another person, which requires protective action. These situations are rare in coaching. If one occurs, the Coach will make every effort to discuss it with you before acting.

Group Confidentiality and Conduct

Group sessions include other clients. You agree to keep confidential everything shared by other participants and by the Coaches in group sessions. You may discuss your own experience in the Program with trusted friends and colleagues, but you agree not to share anything that could identify another participant or what they shared.

You also agree to:

  • Join group sessions from a private location where others cannot see or hear the session.

  • Not record, screenshot, photograph, or transcribe any session, by any means, including AI note-taking tools.

  • Treat other participants with respect.

The Coaches do not record group or individual sessions. The Coaches cannot guarantee that other participants will honor these terms, so share in the group only what you are comfortable sharing.

Electronic Communications

Information sent electronically, including email, text, video, and information stored on internet-connected devices, cannot be fully protected. Unless you use encryption and other security measures, you agree to waive any claim against the Company or the Coaches, and to hold them harmless, for interception of your information sent through these means.

Testimonials

If you choose to write a testimonial or review for Dr. Kyrstin Coaching or The Pivot Path™, you never need to disclose why you sought coaching, what you worked on, or any detail you are not comfortable sharing. You may comment only on your experience with the Coaches, such as their knowledge, communication, encouragement, and professionalism. Our goal is always for you to feel seen, heard, and understood.

No Guarantee of Results

You understand that results are not guaranteed. While many past and current clients have benefited from coaching with the Coaches, and the Coaches will act in their full capacity to support your success, the Company cannot guarantee or make representations about individual results, including obtaining a job, promotion, or particular income. You agree to hold the Company and the Coaches harmless if you do not experience the results you want.

Indemnification

You agree to defend, fully indemnify, and hold harmless the Company, the Coaches, and any affiliates, agents, contractors, or team members from any causes of action, damages, losses, costs, or expenses resulting from your participation in the Program, and from any third-party claims of any kind (including attorney's fees) arising directly or indirectly from your actions during the Program. If the Company or a Coach must defend an action directly or indirectly involving you, or an action in which your participation would benefit the defense, you agree to participate and provide any evidence, documents, testimony, or other information reasonably requested, free of charge.

Mutual Nondisclosure

The Coaches and you may discuss your future plans, business affairs, employer or customer information, finances, job information, goals, and other private information. The Coaches will not voluntarily communicate your information to a third party except as described in this Agreement.

To protect the Company's intellectual property, you agree not to disclose, copy, or distribute any proprietary Program materials, worksheets, frameworks, or methods to third parties. The Pivot Path™ name and materials are the property of their owners and are licensed to you for your personal use only.

These obligations continue during and after the end of the Program.

Dispute Resolution

You (including your assigns, family, and estate) and the Company agree that any controversy or claim arising out of or relating to this Agreement, or its breach, will be settled by arbitration with an accredited arbitrator or arbitration organization mutually agreed upon by the parties. Arbitration may take place by telephone or videoconference. This Agreement is governed by the laws of the State of Georgia, and any in-person proceeding will take place in Forsyth County, Georgia.

Entire Agreement

This Agreement is the entire agreement between you and the Company about the Program. If any part is found unenforceable, the remaining terms stay in effect.

Acknowledgment and Signatures

By signing below, you acknowledge that you have read this Coaching Agreement and Informed Consent, agree to its terms, including the group confidentiality terms, and will abide by them throughout the Program. Both parties will keep a signed and dated copy of this Agreement.
